Title:Sodobni izzivi preiskovanja kaznivih dejanj v digitalnem svetu : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Diplomsko delo obravnava sodobne izzive, s katerimi se soočajo organi preiskovanja in pregona na področju preiskovanja kaznivih dejanj z digitalnim elementom. Sunkovit tehnološki razvoj je namreč povzročil številne (nove) oblike kibernetske kriminalitete, ravno tako pa je povzročil, da so nekateri elementi sicer ne kibernetskih kaznivih dejanj oz. njihovi dokazi nahajajo v digitalni sferi. Na podlagi tega so razločljiva kazniva dejanja z digitalnim elementom, kazniva dejanja povezana s prepovedano vsebino, kot (čista) kibernetska kazniva dejanja, kjer je cilj (nepooblaščeno) vstopiti v informacijski sistem. Vsem naštetim vrstam pa je skupno, da se njihovi dokazi nahajajo pretežno ali v celoti v digitalni sferi, kateri pritičejo številne specifične lastnosti. Šifriranje podatkov, njihova številčnost (volumen), nestanovitnost in razpršenost od organov preiskovanja in pregona, od slednjih terjajo specifične pristope k raziskovanju, ravno tako pa za to izobražen kader in orodja. Pomemben vidik pa predstavlja tudi mednarodno sodelovanje. V diplomskem delu analiziram tudi trenutno ureditev preiskovalnih ukrepov doma in v tujini, pri čemer poskušam odgovoriti na vprašanje ali nacionalna pravna ureditev organom preiskovanja in pregona ponuja dovoljšne možnosti za učinkovito preiskovanje tovrstnih kaznivih dejanj in kakšne so možne rešitve. Izzivi preiskovanja tovrstnih kaznivih dejanj in s tem povezanih (obstoječih in predlaganih) preiskovalnih ukrepov pa so ravno tako analizirani z vidika posegov v človekove pravice in temeljne svoboščine. Diplomsko delo pa tako s pravnega, kot tudi tehničnega vidika analizira tudi možnosti in ovire, s katerimi se organi preiskovanja in pregona soočajo v primeru šifriranja podatkov. Vsak preiskovalni ukrep namreč posega bodisi v obdolženčevo pravico do zasebnosti ali v njegov privilegij zoper samoobtožbo. Glavno vprašanje pa pri tem predstavlja, v katero pravico bo treba poseči, da se organom preiskovanja in pregona omogoči učinkovito preiskovanje in pregon tovrstnih kaznivih dejanj. Dilema posega v privilegij zoper samoobtožbo pa je še tako bolj izrazita z vidika, da (ob pravilni uporabi) šifriranih podatkov ni mogoče prebrati brez sodelovanja obdolženca.

Title:Contemporary challenges of investigating crime in a digital world
Abstract:The thesis addresses the contemporary challenges faced by law enforcement authorities in the field of investigating crimes with a digital element. Technological developments have resulted in many (new) forms of cybercrime, as well as in some elements of non-cybercrime or their evidence being located in the digital sphere. This has led to the distinction between crimes with a digital element, crimes related to prohibited content, and (pure) cybercrime, where the aim is to (unauthorisedly) gain access to an information system. Common to all of these types is the fact that their evidence is found mainly or entirely in the digital sphere, which therefore possesses a number of specific characteristics. The encryption of data, its volume, volatility and dispersion require specific approaches to investigation by law enforcement authorities, as well as trained personnel and tools. Another important aspect is international cooperation. The thesis also analyses the current regulation of investigative measures at home and abroad, trying to answer the question whether the national legal framework offers adequate possibilities for the investigative and prosecution authorities to effectively investigate this type of crime and what possible solutions are available. The challenges of investigating such crimes and the related (existing and proposed) investigative measures are also analysed from the perspective of interference with human rights and fundamental freedoms. The thesis also analyses, from both a legal and a technical perspective, the possibilities and obstacles faced by law enforcement authorities in the case of data encryption. Each investigative measure interferes either with the accused's right to privacy or with his privilege against self-incrimination. The main issue here is which right will have to be encroached upon in order to allow investigative and prosecutorial authorities to effectively investigate such crimes. The dilemma of interfering with the privilege against self-incrimination is even more prominent in view of the fact that (if properly used) encrypted data cannot be read without the participation of the accused.
