Title:Pravice otrok in preprečevanje zlorab v športu : magistrsko delo

Abstract:Otroci imajo kot posebej ranljiva skupina pravico do celovitega varstva svojih temeljnih človekovih pravic tudi v športu. Mednarodna skupnost je zlasti z uveljavitvijo KOP vzpostavila trden pravni okvir, ki otrokom zagotavlja posebno zaščito, ki izhaja iz njihove odvisnosti in razvojnih potreb. Med ključnimi načeli KOP izstopa načelo otrokove koristi, ki mora biti vodilo pri vseh odločitvah, ki vplivajo na otroka, torej tudi v športnih organizacijah. Izjemno pomembno vlogo imajo tudi starši in trenerji, ki morajo delovati odgovorno in v otrokovo korist. Šport otrokom nudi številne priložnosti, hkrati pa predstavlja okolje, kjer lahko pride do kršitev njihovih pravic, zlasti v obliki psiholoških, fizičnih, spolnih zlorab in zanemarjanja. Zato je nujna vzpostavitev mehanizmov, ki zagotavljajo preventivo in ustrezno ukrepanje ob kršitvah. Nacionalni pravni red, zlasti Kazenski zakonik in Zakon o športu, določata nekatere temeljne varovalke, vendar še ne zagotavljata sistemske zaščite otrok v športu. Evropska unija s svojimi pogodbami sicer spodbuja razvoj varnega športnega okolja, a za zdaj še nima pravne podlage za sprejem zavezujočih ukrepov. Za učinkovito zaščito otrok v športu je nujen celovit in usklajen pristop vseh – države, športnih organizacij, trenerjev, staršev in otrok samih. Le z jasno opredeljenimi pravicami, obveznostmi in ničelno toleranco do nasilja lahko otrokom omogočimo varno in spodbudno vključevanje v športne dejavnosti.

Title:Children's Rights and the Prevention of Abuse in Sport
Abstract:Children, as particularly vulnerable group, have the right to comprehensive protection of their fundamental human rights, including in the field of sport. The international community, especially through the adoption of the Convention on the Rights of the Child (CRC), has established a solid legal framework that ensures children receive special protection stemming from their dependency and developmental needs. Among the key principles of the CRC is the best interests of the child, which must guide all decisions affecting children – including those made within sports organisations. Parents and coaches also play a vital role and must act responsibly in the child's best interest. Sport offers children numerous opportunities, but it also creates an environment where their rights may be violated, particularly through psychological, physical, sexual abuse or neglect. It is therefore essential to establish mechanisms that ensure prevention and proper response to such violations. The national legal framework, especially the Criminal Code and the Sports Act, provides certain basic safeguards, but it does not yet ensure systemic protection of children in sport. The European Union, through its treaties, encourages the development of safe sporting environment, but it currently lacks the legal authority to adopt binding measures in this area. To effectively protect children in sport, a comprehensive and coordinated approach is needed from all actors – the state, sport organisations, coaches, parents and the children themselves. Only through clearly defined rights, obligations and zero tolerance policy towards violence, can children be guaranteed safe and encouraging participation in sporting activities.
