Title:Socialni in ekonomski položaj enostarševskih družin v Republiki Sloveniji : magistrsko delo

Abstract:Magistrska naloga obravnava socialni in ekonomski položaj enostarševskih družin v Sloveniji, s poudarkom na analizi njihov pravic v okviru sistema socialne varnosti. V prvem delu naloge so poleg same definicije družine, predstavljeni aktualni trendi spreminjanja družinskih oblik oziroma tako imenovana »pluralizacija družin«, ki je v zadnjih desetletjih opazna tudi v slovenskem pravnem prostoru. Enostarševske družine z otroki namreč predstavljajo tretjino vseh družin v Sloveniji. Kljub formalni (institucionalni) podpori, ter neformalni pomoči, ki jo zagotavljajo različne neprofitne organizacije, podatki mednarodnih in nacionalnih raziskav kažejo, da so enostarševske družine še vedno ena izmed najbolj socialno ranljivih skupin. V primerjavi z drugimi tipi gospodinjstev, se prav slednje soočajo z najvišjo stopnjo tveganja revščine, socialno izključenostjo ter omejenim dostopom do socialno-ekonomskih virov. Poudarek magistrske naloge je na analizi pravnega okvira Republike Slovenije in mehanizmov socialne varnosti, ki vplivajo na položaj enostarševskih družin. Analiza razkriva, da obstajajo različne denarne in nedenarne oblike pomoči enostarševskim družinam, kot so različne pravice in ugodnosti iz sistema socialne varnosti, družinski prejemki, pravice in ugodnosti iz zavarovanja za starševsko varstvo, denarne podpore v vzgojno-izobraževalnem sistemu, ter različni programi nevladnih organizacij, ki pa v nalogi niso posebej obravnavani. Kljub naboru pravic in ugodnosti pa nobena izmed njih ni namenjena izključno enostarševskim družinam, kar odpira vprašanje ustreznosti zakonodaje pri naslavljanja njihovih specifičnih potreb. Prav tako so kljub uvedenim mehanizmov in številnih spremembam v zakonodaji, še vedno prisotne možnosti zlorab sistema socialne varnosti, ki niso nujno posledica namere posameznikov, ampak izhajajo iz sistemskih pomanjkljivosti, kot sta na primer pomanjkanje nadzora (nad sistemom) in omejene kadrovske zmožnosti državnih organov. Navedeno kaže na to, da sistem na tem področju še vedno zahteva izboljšave, predvsem v smislu njegove (večje) učinkovitosti, kar pa je mogoče doseči s prilagoditvijo državnih ukrepov in politik specifičnim potrebam teh družin, pa tudi s krepitvijo nadzornih mehanizmov. Samo celovita in ciljno usmerjena zakonodaja lahko prispeva k zmanjšanju ranljivosti te skupine, obenem pa pripomore k izboljšanju njihovega socialnega in ekonomskega položaja, posledično pa tudi kakovosti njihovega življenja.

Title:Social and economic status of single-parent families in the Republic of Slovenia
Abstract:The master's thesis examines the social and economic position of single-parent families in Slovenia, with particular emphasis on the analysis of their rights within the social security system. In the first part of the thesis alongside the definition of the family itself, current trends in the transformation od family structures – often reffered to as the »pluralisation of families« - are presented, a phenomenon observable in recent decades within the Slovenian legal framework as well. Single-parent families with children constitute approximately one-third of all families in Slovenia. Despite both formal (institutional) support and informal assistence provided by various non-profit organisations, data from international and national studies indicate that single parent families remain among the most socially vunerable groups. Compared to other family units they face the highest risk of poverty, social exclusion and limited access to socio-economic resources. The thesis foruces on the analysis of the legal framework od the Republic of Slovenia and the social security mechanisms that affect the position of single-parent families. The analysis revelars the existace of various monetary and non-monetary forms of assistance to single-parent families, such as different rights and benefirs under the social security system, family allowances, rights and benefits arising from parental protection insurance, financial support within the educational system, as well as various programmes offered by non-governemtal organisations, which, however are not examined in detail in this thesis. Despite the range of rights and benefits, none of them are designed exclusively for single-parent families, which raises questions regarding the adequacy of the legislation in addressing their specific needs. On the other hand, opportuntities for abuse of the social security system remain present. These are not necessarily the result of intentional actons by individuals, but rather stem from systemic shortcomings, such as insufficient oversight and the limited staffing capacities of state authorities. This indicates that the system in this area still requires improvements. Only comprehensive and targeted legislation can contribute to reducing the vulnerability of this group, while also improving their social and economic position, and consequently, their quality of life.
