Title:Odgovornost ponudnika storitev deljenja vsebin na spletu v zvezi s kršitvijo avtorskih pravic : magistrsko delo

Abstract:Magistrsko delo obravnava odgovornost ponudnikov storitev deljenja vsebin na spletu v zvezi s kršitvami avtorskih pravic. Zaradi hitrega napredka digitalnih tehnologij se pojavljajo novi načini izkoriščanja avtorskih del, hkrati pa se pojavljajo tudi nove možnosti kršitve avtorskih pravic. Nenehno spreminjanje regulativnega okvirja na področju avtorske in sorodnih pravic je zato vselej pomembno. K temu je prispevala Direktiva 2019/790, ki je na področju avtorskega prava na digitalnem trgu v EU osrednji predpis. S členom 17 je določila nov režim odgovornosti ponudnikov storitev deljenja vsebin na spletu. V nalogi je prikazano, kako je sodna praksa Sodišča EU s široko razlago pojma priobčitve javnosti že pred sprejetjem Direktive 2019/790 pripisovala odgovornost PSDVS za kršitve avtorske in sorodnih pravic, ki so jih izvedli uporabniki platform. Ti so takrat še zmeraj imeli možnost, da se razbremenijo na podlagi določbe varnega pristana iz člena 14(1) Direktive 2000/31 (zdaj urejene v členu 6 Akta o digitalnih storitvah). Nova ureditev po Direktivi 2019/790 pa PSDVS omogoča razbremenitev odgovornosti za dejanja priobčitve njihovih uporabnikov le, če delujejo v skladu s predpisanimi obveznostmi. Te obveznosti so prizadevanje za pridobitev dovoljenja od imetnikov pravic, vzpostavitev avtomatiziranega sistema filtriranja vsebin, in da ob prejemu utemeljenega obvestila imetnika ravnajo hitro, da kršitve odstranijo ter preprečijo dostopnost prijavljenih vsebin v prihodnje. V povezavi z izpolnjevanjem slednjih obveznosti naletimo na določene ovire. Zakonodajalec EU je z obveznostjo prizadevanja za pridobitev dovoljenja želel preprečiti nastajanje vrednostne vrzeli med PSDVS in imetniki pravic. Ker standard „prizadevanja za pridobitev dovoljenja“ ni pojasnjen, cilj po zmanjševanju vrednostne vrzeli ni učinkovito izpolnjen. Konkretizacija standarda je zato pri prenosu Direktive 2019/790 vselej potrebna. Največ polemik se pri novi ureditvi pojavlja glede obveznosti vzpostavitve sistema avtomatiziranega filtriranja vsebin. Ta namreč lahko privede do situacije prekomernega blokiranja vsebin, kar ogroža pravico uporabnikov do svobode izražanja na spletu. Magistrsko delo zato preučuje pravne mehanizme, s katerimi je mogoče takšne situacije preprečiti. Podani sta dve rešitvi, in sicer možnost predhodnega označevanja (pre-flagging) in izjema za krajša dela. Ti mehanizmi so bili vzpostavljeni v nemškem pravnem sistemu ob prenosu Direktive 2019/790 in so prepoznani kot učinkovita sredstva za preprečitev prekomernega posega v svobodo izražanja. Obveznost vzpostavitve avtomatiziranega sistema filtriranja je lahko problematična tudi z vidika prepovedi splošne obveznosti spremljanja, zato naloga obravnava tudi problem pravne negotovosti, ki se pojavlja pri razmerju med obveznostjo vzpostavitve sistema filtriranja in prepovedjo splošne obveznosti spremljanja. V nalogi je obravnavana tudi sodba Youtube/Cyando ter odgovor na vprašanje, kako nova ureditev odgovornosti PSDVS vpliva na izid v zadevnem primeru. Ugotovljeno je, da se je že pred sprejetjem Direktive 2019/790 Sodišče EU nagibalo k vzpostavitvi režima odgovornosti kot ga poznamo danes, kljub temu pa lahko opazimo tudi določene spremembe.

Title:Liability of online content-sharing service providers in relation to copyright infringements
Abstract:The master's thesis deals with the libality of online content sharing service providers in relation to copyright infringements. Due to the rapid progress of digital technologies, new ways of exploiting copyright works and new possibilites of copyright infringements are emerging. The continious change of the regulatory framework in the field of copyright and related rights is therefore very important. Changes in copyright laws were introduced with the adoption of Directive 2019/790, which regulates the copyright law on the digital market in EU. With Article 17, it established a new regime of liablity of online content sharing service providers. Court of Justice of the EU attributed liablity to online content sharing service providers for copyright infingements by its users with a broad interpretation of the concept of communication to the public even before the adoption of Directive 2019/790. At that time, online content sharing service providers still had the possibilty of not being held liable on the basis of the safe harbour provision in Article 14(1) of Directive 2000/31(now in Article 6 of the Digital Services Act). The new regulation under Directive 2019/790, however, allows online content sharing service providers to not be held liable for the act of communication to the public by its users only if they act in accordance with the prescribed obligations. These obligations are: to made best efforts to obtain authorisation by the rightholder; to establish an automated content filtering system; and to act expeditiously, upon receiving a notice from the rightholder, to disable access to the content and prevent further infringements. In connection with the fulfillment of the latter obligations, we encounter certain obstacles. With the obligation to make best efforts to obtain an authorisation, the EU legislator wanted to prevent the creation of a value gap between the online content sharing service providers and the rightholders. Since the latter standard is not clarified, the goal of reducing the value gap is not effectively met. When member states implement such standard, its clarification is therefore always necessary. The most controversial obligation in the new regulation is the obligation to establish an automated content filtering system. This can lead to a situation of excessive content blocking, which threatens the right of users to freedom of expression online. The master's thesis therefore examines legal mechanisms with which such situations can be prevented. Two solutions are given, namely the possibilty of pre-flagging and exceptions for minor uses. These mechanisms were established in the German legal system upon the impelemtation of the Directive 2019/790 and are recognized as an effective means of preventing excessive interference with the freedom of expression. The obligation to establish an automated filtering system may also be problematic in relation to the prohibition of general monitoring obligation. Therefore master's thesis addresses the problem of legal uncertainty that arises in the relationship between the latter obligation and the prohibition. The thesis also discusses Youtube/Cyando judgement and how the new liability regime affects the outcome of the case in question. It was found that even before the adoption of the Directive 2019/790, the Court of Justice of the EU was inclined to establish the liablilty regime as we know it today, athough certain changes can also be observed.
