Title:Usposabljanje policistov za uporabo električnega paralizatorja v Sloveniji v primerjavi z izbranimi tujimi praksami : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu smo proučili usposabljanje in uporabo električnega paralizatorja v slovenski policiji ter ju primerjali s praksami izbranih evropskih držav. Osredotočili smo se na pravni okvir, upoštevanje načel uporabe električnega paralizatorja ter na vlogo usposabljanja policistov pri zakoniti, strokovni in pravilni uporabi tega prisilnega sredstva. V Sloveniji je bil električni paralizator v policijsko prakso uveden leta 2020, njegova uporaba pa je zakonsko jasno opredeljena in omejena na posebej določene pogoje. Statistični podatki kažejo, da je naprava na voljo le omejenemu številu slovenskih policistov, saj je trenutno usposobljenih 375, kar predstavlja približno pet odstotkov vseh uniformiranih in neuniformiranih policistov. V uporabi je 35 električnih paralizatorjev, kar prav tako vpliva na nizko število primerov uporabe. Primerjava s tujino, zlasti z Veliko Britanijo in Francijo, je pokazala, da se električni paralizator uporablja bistveno pogosteje. Na izrazite razlike ne vpliva zgolj večje število prebivalcev v posamezni državi, temveč predvsem milejši pogoji za uporabo, organizacijska kultura in notranja pravila policije ter širša dostopnost naprave. Kljub razlikam imajo v tujini podobne programe usposabljanja, saj vsi temeljijo na smernicah proizvajalca električnih paralizatorjev. V vseh obravnavanih državah je usposabljanje razdeljeno na teoretični del, praktično vadbo in redno obnovitveno usposabljanje. Ugotovili smo, da je električni paralizator pomembno orodje policista, ki lahko v kritičnih situacijah zmanjša tveganje hudih poškodb tako pri policistih kot pri osebah, zoper katere se ukrepa, vendar pa je njegova uvedba sprožila dileme glede sorazmernosti, zakonitosti in nadzora nad uporabo. Statistični podatki kažejo, da je uporaba tega prisilnega sredstva v Sloveniji v primerjavi s tujino zelo redka, predvsem zaradi strogih zakonskih pogojev uporabe in omejene dostopnosti naprave. Organizacijska ureditev policije in pravni okvir tako ostajata ključna dejavnika, ki določata obseg in način uporabe električnega paralizatorja v praksi.

Title:Police training for the use of conducted electrical weapons in Slovenia and abroad
Abstract:In our diploma thesis, we examined the training and use of the conducted electrical weapon in the Slovenian police and compared it with the practices of selected European countries. The focus was placed on the legal framework, the principles governing the use of the conducted electrical weapon, and the role of police training in ensuring the proper, lawful, and professional application of this means of coercion. The conducted electrical weapon was introduced into Slovenian police practice in 2020, and its use is clearly defined by law and restricted to specifically determined conditions. Statistical data show that the device is used by only a limited number of Slovenian police officers, with 375 officers currently trained, representing approximately five percent of all uniformed and non-uniformed police officers. There are currently 35 conducted electrical weapons in use, which also contributes to the low number of actual deployments. A comparison with foreign countries, particularly United Kingdom and France, revealed that the conducted electrical weapon is used significantly more frequently. The substantial differences are not only the result of larger populations in these country, but also stem from more lenient conditions for use, the organizational culture and regulations of the police, as well as broader availability of the device. Despite the above differences, training programs abroad follow a similar structure, as all are all based on the guidelines, provided by the manufacturer of the conducted electrical weapon. In all the countries studied, training is divided into theoretical modules, practical training and regular refresher courses. The findings indicate that the conducted electrical weapon is an important policing tool that, in critical situations, can reduce the risk of serious harm to both officers and persons against whom it is used. However, its introduction has simultaneously raised dilemmas concerning proportionality, legality and oversight. Statistical data show that the use of this coercive means in Slovenia is very rare compared to other countries, primarily due to the strict legal conditions of use and limited availability of the device. The organizational structure of the police and the legal framework therefore remain key factors determining the scope and manner of using the conducted electrical weapon in practice.
