Title:Primerjalna analiza vojaških policij v izbranih državah : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Vojaška policija je organ, ki v obrambnem sistemu s svojimi pooblastili zagotavlja red in disciplino, ter izvajanje nalog vojske v skladu z zakonodajo in pravnimi akti države. Zaradi raznolikih državnih ureditev, so se ustvarile različne strukture delovanja vojaških policij, med glavni dve pa spadata sistem žandarmerije in klasičen sistem vojaške policije. Žandarmerija je hibridna organizacija, saj je policijska sila z vojaškim statusom in lahko hkrati deluje kot vojaška in kot policijska institucija. Glavne naloge se bistveno ne spreminjajo znotraj obeh sistemov, največja razlika pa se izkaže v hibridnemu delovanju žandarmerije. V klasičnem sistemu lahko vojaški policisti strogo delujejo le znotraj svoje vojske in vojaških enot, medtem ko je žandarmeriji omogočeno izvajanje pooblastil kot vojaška sila znotraj vojske, kot tudi izven nje nad civilnim prebivalstvom v obliki policijske sile. Slovenija in Združeno kraljestvo delujeta po principu klasičnega sistema vojaške policije, Italija in Francija pa po sistemu žandarmerije. Podobnosti se kažejo v osnovnih nalogah: zagotavljanje in izvrševanje reda, discipline, zakonov, pravil, vrednot in človekovih pravic. Največje razlike se kažejo v organizacijskih strukturah vojaških policij, ki so posledice različne zgodovine, kulture, socialnega, ekonomskega in političnega stanja držav. Hibridno delovanje Italije in Francije omogoča tesno povezanost med vojsko in lokalnimi oblastmi, ter boljši pregled nad varnostnim sistemom celotne države, a s tem zamegli mejo razlikovanja specifičnih vojaških in policijskih dolžnosti. Slovenija in Združeno kraljestvo z omejevanjem vojaške policije le znotraj vojaških enot, omogočata podroben nadzor nad izvrševanjem vojaških nalog in pooblastil, a s tem potrebujeta podrobnejše opredelitve o strukturah lastnih policijskih enot, ter pristojnosti njihovega delovanja.

Title:Comparative analysis of military police in selected countries
Abstract:The military police is a military force, that ensures order, discipline and the performance of military tasks in accordance to the legislation and legal acts of the state. Due to the diversity of national regulations, different orgnisational and operational structures of the military police have been created. Two of the most common ones are the gendarmerie system and the classic military police system. The gendarmerie is a police force with military status, a hybrid organisation, that can function both as a military and a police institution. The main policing tasks do not differ significantly between the two systems, the main difference being the hybrid nature of the gendarmerie system. Military police officers in the classical system can operate only within the boundaries of their army and military units, while the gendarmerie forces are allowed to police military personel as a military force and the civilian population as a police force. Slovenia and the United Kingdom operate according to the classic military police system, while Italy and France operate according to the gendarmerie system. Similarities in both systems are evident in their basic tasks: ensuring and enforcing order, discipline, laws, rules, values and human rights. The differences lie in the organisational structures of the military police resulting from hisotrical, cultural, social, economical and political differences of the countries. The hybrid gendarmerie structure allows Italy and France to have a better collaboration between the military and local authorities and a better overview of the countries security systems, but lacks a more defined line between specific military and police duties. Slovenia and the United kingdom gained more detailed control over the use of military tasks and policing powers, by limiting them to actual military units and personel, but that also requires them to have more accurate definitions of their policing units structures and the scope of their powers.
