Abstract:Magistrsko delo obravnava pravno problematiko dedovanja spletnega premoženja, ki zaradi digitalizacije postaja pomemben del zapuščin. Tradicionalno dedno pravo, prilagojeno fizičnim sredstvom, ne zmore celovito obravnavati vprašanj dostopa, prenosa in pravne narave digitalnih sredstev. Glavno težavo predstavljajo tehnične ovire (gesla, zasebni ključi), neprenosljivost spletnih računov ter omejitve iz pogodbenih pogojev ponudnikov storitev. Delo obravnava štiri ključne kategorije digitalnega premoženja: sredstva na elektronskih napravah, spletne račune in vsebine, digitalne vsebine kupljene v licenčnem režimu ter kriptovalute in NFT. Posebej izstopa izziv dedovanja kriptovalut, kjer brez zasebnega ključa dediči ne morejo dostopati do premoženja, kar povzroča trajne izgube. Čeprav ZD temelji na načelu univerzalnega nasledstva, je njegova uporaba pri digitalnih sredstvih v praksi omejena. Pravna ureditev je neenotna tudi med državami: Nemčija je z odmevno sodno prakso priznala dedljivost spletnih računov, ZDA z RUFADAA in Francija s PACTE pa uvajata posebne rešitve. Ugotovitve dela potrjujejo potrebo po jasni zakonski definiciji digitalne zapuščine, obveznosti ponudnikov pri posredovanju podatkov dedičem ter razvoju tehnoloških rešitev za načrtovanje digitalnega dedovanja, saj le celovita ureditev zagotavlja pravno varnost in predvidljivost.

Title:Inheritance of digital assets
Abstract:This master’s thesis examines the legal challenges of inheriting digital assets, which have become an increasingly important part of modern estates due to ongoing digitalisation. Traditional inheritance law, designed for tangible property, cannot adequately address issues related to the transfer, access and legal classification of digital assets. The main problems arise from technical barriers (passwords, private keys), the non-transferable nature of many online accounts, and restrictive contractual terms imposed by service providers. The thesis identifies four key categories of digital assets: data stored on electronic devices, online accounts and hosted content, licensed digital goods, and cryptocurrencies/NFTs. Particular difficulties emerge in relation to cryptocurrencies, where access is entirely dependent on private keys—resulting in significant and irreversible asset loss. Although the Slovenian Inheritance Act is based on the principle of universal succession, its application to digital assets is limited in practice. International approaches vary: Germany’s case law has confirmed the inheritability of social media accounts, while the United States (RUFADAA) and France (PACTE) have adopted targeted regulatory solutions. The findings highlight the need for clear statutory definitions of digital estates, obligations for digital service providers to grant lawful access to heirs, and the development of technological tools—such as blockchain-based solutions—for effective digital estate planning.
