Abstract:Evidenca delovnega časa v teoriji in praksi Evidentiranje delovnega časa predstavlja eno izmed temeljnih orodij za zagotavljanje preglednosti in pravičnosti v delovnih razmerjih. Za delodajalce je natančno beleženje opravljenih ur in upravičenih odsotnosti pomembno z vidika organizacije in načrtovanja dela ter spremljanja produktivnosti, za delavce pa pomeni zagotovilo, da je njihovo delo ustrezno priznano in ovrednoteno. Verodostojna evidenca o izrabi delovnega časa ima za delavca ključno vlogo pri spoštovanju njegovih pravic iz naslova delovnega časa (zagotovljeni dnevni in tedenski počitki, ustrezna razporeditev delovnega časa, izplačilo dodatkov ...) ter varnosti in zdravja pri delu. Sodobni delovni procesi doživljajo izrazite spremembe. Digitalizacija, delo na daljavo, fleksibilne oblike dela so spremenili razumevanje klasičnega delovnega časa. Delo se vse pogosteje opravlja izven tradicionalnih prostorov in urnikov, kar zahteva večjo avtonomijo ter zaupanje med delavcem in delodajalcem. Evidentiranje delovnega časa je v slovenskem pravnem sistemu obvezno že od leta 2006, zato t. i. »štempljanje« ob prihodu na delo in odhodu z dela ne predstavlja novosti. V zadnjih letih je ZEPDSV iz 2006 doživel več sprememb glede evidentiranja delovnega časa, kar je sprožilo številne kritike in razprave med širšo javnostjo oziroma med delodajalci in delavci, katerih delo je prilagojeno prožnemu in fleksibilnemu delu. Po eni strani ZEPDSV zahteva podrobno beleženje podatkov iz naslova delovnega časa, po drugi strani pa ne razlikuje med delodajalci, ki imajo različno organizirane delovne procese oziroma ne omogočajo ustreznega zajema fleksibilnih oblik dela, ki jih narekuje sodobno gospodarstvo. ZEPDSV velja za vse delodajalce enako, ne glede na njihovo organizacijo dela. Posledica je razkorak med normativnim okvirom in dejanskim stanjem na trgu dela. Pri delodajalcih, kjer v odnosu do delavca prevladuje zaupanje in samostojno delo, se evidenca o delovnem času pogosto dojema kot ovira za fleksibilnost, v sektorjih, kjer so zaposleni ranljivi delavci (gradbeništvo, turizem, gostinstvo ...) pa ostaja ključno orodje za zaščito delavcev pred preobremenjenostjo in zlorabami. Ključni izziv prihodnosti je zato vzpostaviti ravnovesje med zaščitno funkcijo evidenc o izrabi delovnega časa in potrebo po prožnosti delovnih procesov. Le s prilagoditvijo sistemov beleženja bo mogoče zagotoviti učinkovito in pravično spremljanje dela v času, ko se meja med zasebnim in poklicnim življenjem vse bolj briše.

Title:The record of working time in theory and practice
Abstract:The record of working time in theory and practice Recording working hours is one of the fundamental tools for ensuring transparency and fairness in employment relationships. For employers, accurate tracking of hours worked and justified absences is important for organizing and planning work, as well as monitoring productivity. For employees, it is a guarantee that their work is properly recognized and valued. Reliable records of working hours play a key role in respecting employees’ rights related to working time (such as daily and weekly rest, proper scheduling of working hours, payment of bonuses, etc.) and in ensuring safety and health at work.However, modern work processes are changing rapidly. Digitalization, remote work, and flexible work arrangements have transformed the traditional understanding of working hours. Work is increasingly done outside of traditional workplaces and schedules, which requires more autonomy and trust between employees and employers. In the Slovenian legal system, recording working hours has been mandatory since 2006, so "clocking in" and "clocking out" is not a new practice. In recent years, the ZEPDSV law from 2006 has undergone several changes regarding working time records, which has sparked many criticisms and debates among the public, employers, and employees whose work is adapted to flexible arrangements. On one hand, ZEPDSV requires detailed recording of working time data; on the other hand, it does not distinguish between employers with different work processes or allow for proper tracking of flexible work forms required by the modern economy. ZEPDSV applies equally to all employers, regardless of how their work is organized. As a result, there is a gap between the legal framework and the actual situation in the labor market. In workplaces where trust and independent work prevail, working time records are often seen as an obstacle to flexibility. In sectors with vulnerable workers (such as construction, tourism, hospitality), records remain a key tool for protecting employees from overwork and abuse. The main challenge for the future is to find a balance between the protective function of working time records and the need for flexible work processes. Only by adapting recording systems can we ensure effective and fair monitoring of work at a time when the line between private and professional life is increasingly blurred.
