Title:Obravnava dopinga v odločitvah Arbitražnega razsodišča za šport : magistrsko delo

Abstract:V magistrskem delu je doping obravnavan skozi odločitve Arbitražnega razsodišča za šport, s poudarkom na načelu objektivne odgovornosti športnika za kršitev protidopinških pravil. Doping se uporablja že tisočletja, in sicer kot sredstvo za povečanje telesne zmogljivosti ter posledično tudi rezultatov. Arbitražno razsodišče za šport je bilo ustanovljeno z namenom zajezitve dopinga, ki se je v 20. stoletju razširil in škodil ugledu tako športa kot posameznikom samim. Arbitražno razsodišče za šport ustvarja t. i. lex sportivo in principa sportiva, pri čemer ima pomembno vlogo tudi pri razlagi športnega prava. Poleg tega je pri omejevanju dopinga v športu ključna še vloga Svetovne protidopinške agencije, katere najpomembnejša naloga je bila priprava enotnega protidopinškega kodeksa. Z analizo odločitev Arbitražnega razsodišča za šport je bilo v magistrskem delu ugotovljeno, da se le redko odstopa od strogega načela objektivne odgovornosti. Načelo objektivne odgovornosti na področju kršitev pravil dopinga pomeni, da organu ni treba dokazovati športnikove krivde, namena, malomarnosti ali zavestne uporabe določene prepovedane substance in metode. Pomembna naloga vsakega športnika je, da prepreči, da bi kakršna koli prepovedana snov oziroma substanca prišla v njegov organizem oziroma da bi bila uporabljena prepovedana metoda. Standard ravnovesja verjetnosti športniku omogoča, da uspešno dokazuje, kako je prepovedana substanca prišla v njegov organizem, ter se na podlagi načela sorazmernosti, v okviru katerega se ugotavljata športnikova krivda ali malomarnost, razbremeni odgovornosti za kršitev protidopinških pravil ali pa se mu zniža obdobje prepovedi sodelovanja na tekmovanjih. Športniki so v okviru pravil dopinga odgovorni za dejanja svojega ožjega spremstva, kamor tudi trenerji in zdravniki. Za kršitev protidopinških pravil v ekipnih športih, v katerih je mogoča menjava tekmovalcev med samim tekmovanjem, Svetovni protidopinški kodeks predvideva sankcije, kot so diskvalifikacija, prepoved tekmovanja, odvzem odličij in nagrad.

Title:Review of decisions made by the court of Arbitration for sport on doping
Abstract:The master's thesis focuses on doping as reflected in the decisions of the Court of Arbitration for Sport, with an emphasis on the strict liability principle of athletes for violating anti-doping rules. Doping has been used for thousands of years as a performance-enhancing drug to improve physical performance and results. The Court of Arbitration for Sport was established to combat doping, which spread in the 20th century and damaged the reputation of sport as well as that of individuals. The Court of Arbitration for Sport creates the so-called lex sportiva and principa sportiva. It also plays an important role in interpreting the law. At the same time, the World Anti-Doping Agency plays an important role in combating doping in sport, and its most important task has been the creation of a uniform anti-doping code. An analysis of the decisions of the Court of Arbitration for Sport has shown that there are only rare deviations from the strict liability principle. The strict liability principle in the field of doping violations means that the authority does not need to prove the athlete's guilt, intent, negligence, or deliberate use of a particular prohibited substance or method. An important task for every athlete is to prevent any prohibited substance from entering their body or any prohibited method from being used. The balance of probability allows the athletes to successfully prove how the prohibited substance entered their body, and based on the principle of proportionality, which determines the athlete’s fault or negligence, to be relieved of responsibility for violating anti-doping rules or to have their period of ineligibility reduced. Athletes are also responsible for the actions of their close entourage, which includes coaches and doctors. For violations of anti-doping rules in team sports where it is possible to substitute players during the competition, the World Anti-Doping Code provides sanctions such as disqualification, competition bans and the loss of medals and prizes.
