Title:Algoritemska konkurenca in pravna (ne)preglednost: kakšen domet ima trenutna pravna ureditev EU?

Abstract:Naraščajoča uporaba umetne inteligence na digitalnih trgih uvaja nove razsežnosti v konkurenčna razmerja in odpira vprašanja glede zmožnosti obstoječega pravnega okvira, da se ustrezno odzove na te izzive. Čeprav lahko algoritmi povečajo učinkovitost in predvidljivost na trgu, hkrati omogočajo tudi tiho usklajevanje, algoritmično koordinacijo in potencialne zlorabe prevladujočega položaja – pogosto brez neposredne človeške namere ali klasičnih dokazov o protipravnem dogovarjanju. Prispevek obravnava vprašanje, ali trenutna pravila EU na področju konkurenčnega prava – zlasti 101. in 102. člen PDEU – ter novi zakonodajni instrumenti EU o umetni inteligenci vsebujejo zadostne rešitve za pojave algoritemske konkurence. Na podlagi doktrinarnih stališč in z uporabo klasičnih metod raziskovanja v pravu, zlasti teleološke in endogene primerjalne metode, so ovrednoteni obstoječi pravni instituti in izpostavljena področja, kjer so potrebne dodatne pravne rešitve ali inovativnejši razlagalni pristopi v praksi.

Title:Algorithmic competition and legal (in)transparency: what Is the reach of the current legal framework of the EU?
Abstract:The increasing use of artificial intelligence in digital markets introduces new dimensions to competitive relationships. It raises questions about the ability of the existing legal framework to respond to these challenges adequately. While algorithms can increase efficiency and predictability in the market, they also allow for tacit coordination, algorithmic coordination and potential abuses of dominance - often without direct human intent or classical evidence of collusion. The chapter addresses whether the current EU competition law rules - in particular, Articles 101 and 102 TFEU - and the new EU legislative instruments on artificial intelligence contain sufficient solutions to the emergence of algorithmic competition. Drawing on doctrinal perspectives and using classical methods of legal research, in particular the teleological and endogenous comparative methods, it evaluates existing legal institutions and highlights areas where additional legal solutions or more innovative interpretative approaches are needed in practice.
