Title:Sodna praksa Evropskega sodišče za človekove pravice pred Sodiščem Evropske unije : magistrsko delo

Abstract:Magistrska naloga obravnava vpliv Evropskega sodišča za človekove pravice na sodno prakso Sodišča Evropske unije s poudarkom na tem, kako standardi Evropske konvencije o človekovih pravicah oblikujejo in usmerjajo razvoj varstva temeljnih pravic v pravnem redu Evropske unije. Čeprav Evropska unija uradno še ni pristopila k Evropski konvenciji o človekovih pravicah, razmerje med obema sodiščema ostaja ključni element evropskega sistema zaščite temeljnih pravic. Namen naloge je preučiti, kako sodna praksa Evropskega sodišča za človekove pravice vpliva na razlago in oblikovanje temeljnih pravic pri Sodišču Evropske unije, pri čemer se vpliv najbolje odraža v konkretnih zadevah. Osrednji doprinos magistrske naloge je sistematičen prikaz zgodovinskega in konceptualnega razvoja, v katerem je Sodišče Evropske unije postopoma sprejemalo in vključevalo standarde Evropskega sodišča za človekove pravice, hkrati pa ohranjalo avtonomijo pravnega reda Evropske unije. Pred pravno zavezujočim uveljavljanjem Listine Evropske unije o temeljnih pravicah je Evropska konvencija predstavljala glavni referenčni dokument za oblikovanje splošnih načel prava EU. Po uveljavitvi Listine Evropske unije o temeljnih pravicah Sodišče Evropske unije razvija lastne standarde varstva pravic, čeprav se še vedno opira na sodno prakso Evropskega sodišča za človekove pravice. Posebna pozornost je namenjena sodni praksi, kjer je vpliv Evropskega sodišča za človekove pravice najbolj očiten, zlasti na področjih evropskega naloga za prijetje, azila in migracij ter pravice do pozabe. Analiza kaže, da Evropsko sodišče za človekove pravice pogosto deluje kot minimalni standard, ki ga Sodišče Evropske unije nadgrajuje ali povzema v svojih ključnih odločbah, kar omogoča poglobljeno razumevanje sodnega dialoga in normativnega vpliva med obema sodiščema. Ugotovitve naloge kažejo, da sodna praksa Evropskega sodišča za človekove pravice pomembno oblikuje raven varstva temeljnih pravic v Evropski uniji, saj vpliva na razlago temeljnih pravic pri Sodišču Evropske unije. Sodišče Evropske unije ta vpliv sprejema selektivno in previdno, da krepi varstvo človekovih pravic, hkrati pa ohranja svojo avtonomijo. Tema sodnega dialoga je zelo aktualna v pravnih krogih, kar dokazujejo številne akademske razprave in kritike. Posledično se v dialogu med obema sodiščema oblikuje evropski pravni prostor, kjer je raven zaščite temeljnih pravic odvisna od njihove medsebojne interakcije in spoštovanja pristojnosti.

Title:Case law of the european court of human rights before the court of justice of the european union
Abstract:This master’s thesis examines the influence of the European Court of Human Rights on the case law of the Court of Justice of the European Union, with a particular focus on how standards developed under the European Convention on Human Rights shape and guide the protection of fundamental rights within the European Union legal order. Although the European Union has not formally acceded to the European Convention, the relationship between the two courts remains a central element of the European human rights protection system. The aim of this thesis is to analyze how the case law of the European Court of Human Rights affects the interpretation and development of fundamental rights by the Court of Justice of the European Union, with the impact most clearly visible in specific cases. The main contribution of the thesis lies in providing a systematic account of the historical and conceptual development through which the Court of Justice of the European Union gradually incorporated standards of the European Court of Human Rights while maintaining the autonomy of the EU legal order. Before the Charter of Fundamental Rights of the European Union became legally binding, the European Convention served as the primary reference for shaping general principles of EU law on fundamental rights. Since the Charter’s entry into force, the Court of Justice of the European Union has increasingly developed its own standards of rights protection, while still drawing on the case law of the European Court of Human Rights. Special attention is given to case law where the influence of the European Court of Human Rights is most evident, particularly in areas such as the European Arrest Warrant, asylum and migration, and the right to be forgotten. The analysis shows that the European Court of Human Rights often functions as a baseline or minimum standard, which the Court of Justice of the European Union either enhances or incorporates in key rulings, allowing for a nuanced understanding of the judicial dialogue and normative influence between the two courts. The findings demonstrate that the case law of the European Court of Human Rights significantly shapes the level of fundamental rights protection in the European Union, influencing how the Court of Justice of the European Union interprets these rights. The Court of Justice adopts this influence selectively and cautiously, strengthening human rights protection while preserving its own legal autonomy. The topic of judicial dialogue is highly relevant in legal scholarship, as evidenced by numerous academic studies and critiques. Consequently, the interaction between the two courts contributes to a European legal space where the protection of fundamental rights depends on their mutual interaction and respect for institutional competences.
