Title:Privatizacija zaporov v izbranih evropskih državah : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomski nalogi predstavljamo privatizacijo zaporov v Evropi in po svetu s poudarkom na izbranih evropskih državah: Anglija in Wales, Belgija, Francija, Nemčija, Nizozemska in Škotska. V prvem delu diplomskega dela predstavimo zgodovino razvoja zasebnih zaporov ter prednosti in slabosti privatizacije zaporske dejavnosti. Poznamo tri vrste zaporskih sistemov glede na lastništvo in odgovornost: državni sistem, sistem javno-zasebnega partnerstva in zasebne zapore. Nadalje lahko oblike privatizacije razdelimo na: 1) popolno privatizacijo, kjer zasebniki izvajajo nadzorovanje, varovanje in druge dejavnosti v zaporih, in 2) mešani model, kjer varovanje in nadzorovanje ostaja v rokah državnih uslužbencev, zasebniki pa izvajajo gradnjo, vzdrževanje, obnavljanje, logistiko in številne druge nenadzorstvene naloge v zaporskem okolju (čiščenje, kuhanje, skrb za odpadke, vzdrževanje tehničnih sredstev ipd.). V drugem delu zaključnega dela smo opravili primerjalno analizo javno-zasebnega partnerstva v izbranih evropskih državah. Razlogi za uvajanje javno-zasebnega partnerstva v izbranih evropskih državah se kažejo v povečanju zaporske populacije, zagotavljanju boljših pogojev za prestajanje kazni zapora in delovnih pogojev zaporskega osebja ter omejenosti državnih proračunov. Ugotovitve so pokazale, da se razvoj javno-zasebnega partnerstva v Veliki Britaniji pomembno razlikuje od kontinentalne Evrope oziroma držav Evropske unije. V preučevanih evropskih državah privatizacija zaporov poteka kot javno-zasebno partnerstvo v obliki polne privatizacije in javno-zasebno partnerstvo za gradnjo, vzdrževanje in logistiko. Namen privatizacije je v inovacijah, modernizaciji, prijaznejših odnosih med zaporskimi akterji in ekonomičnosti. Nezaželeni učinki privatizacije se kažejo v težavah z varnostjo, visoko fluktuacijo kadra, višjimi stroški od pričakovanih in slabšo kakovostjo dela ter zaposlenimi z manj pravicami kot v javnem sektorju.

Title:Privatisation of prisons in selected european countries
Abstract:In the thesis, we present the privatisation of prisons in Europe and around the world, with an emphasis on selected European countries: England and Wales, Belgium, France, Germany, the Netherlands and Scotland. In the first part of the thesis, we present the history of the development of private prisons and the advantages and disadvantages of the privatisation of prison activities. There are three types of prison systems in terms of ownership and responsibility: the state system, the public-private partnership system and private prisons. Furthermore, the forms of privatisation can be divided into: 1) full privatisation, where private individuals carry out supervision, security and other activities in prisons and 2) a mixed model, where security and supervision remain in the hands of state employees, and private individuals carry out construction, maintenance, renovation, logistics and many other non-supervisory tasks in the prison environment (cleaning, cooking, waste management, maintenance of technical equipment, etc.). In the second part of the thesis, we conducted a comparative analysis of public-private partnerships in selected European countries. The reasons for introducing public-private partnerships in selected European countries are reflected in the increase in the prison population, the provision of better conditions for serving prison sentences and working conditions for prison staff, and the limitations of state budgets. The findings showed that the development of public-private partnerships in Great Britain differs significantly from continental Europe or the countries of the European Union. In the European countries studied, the privatisation of prisons is taking place as a public-private partnership in the form of full privatisation and public-private partnerships for construction, maintenance and logistics. The purpose of privatisation is innovation, modernisation, friendlier relations between prison actors and cost-effectiveness. The undesirable effects of privatisation are reflected in problems with security, high staff turnover, higher than expected costs, poorer quality of work, and employees with fewer rights than in the public sector.
