Title:Kazenska odgovornost poveljnikov in drugih nadrejenih za mednarodna kazniva dejanja po Rimskem statutu : magistrsko delo

Abstract:Mednarodna kazniva dejanja so najtežja kazniva dejanja, ki ne vplivajo le na posameznike kot žrtve, temveč na celotno družbo in sistem, v katerem so bila izvršena. Za organe pregona na nacionalni ravni predstavljajo poseben izziv, saj se nacionalni preiskovalci in tožilci v teh zadevah soočajo z vrsto zapletenih dejanskih in pravnih vprašanj. V ospredju je Mednarodno kazensko sodišče, ki je bilo ustanovljeno kot posledica zasledovanja cilja preprečevanja nekaznovanosti in predstavlja sodišče zadnje instance, ki posreduje le, kadar nacionalni pravni sistemi niso sposobni ali pripravljeni preiskovati in kazensko preganjati storilcev mednarodnih kaznivih dejanj. Že ob ustanovitvi MKS je bilo jasno, da se bo kazenski pregon osredotočal na najodgovornejše storilce, torej poveljnike in voditelje. Magistrsko delo obravnava mednarodno kazensko odgovornost poveljnikov in drugih nadrejenih za mednarodna kazniva dejanja po Rismkem statutu. Kazenski pregon posameznikov, zlasti voditeljev držav, za mednarodne zločine se sooča s političnimi, pravnimi in dejanskimi ovirami. Temu je v delu namenjen tudi poseben poudarek. Obravnavani so tudi pomembnejša sodna praksa mednarodnih kazenskih sodišč ter novi mehanizmi mednarodnega sodelovanja in razmišljanje o prihodnosti pregona mednarodnih kaznivih dejanj. Analiza kaže, da je prihodnost mednarodnega kazenskega prava nacionalna in da je v tem tudi rešitev za učinkovitejši pregon poveljnikov in drugih nadrejenih. To sicer ne pomeni, da Mednarodno kazensko sodišče ne bo več potrebno, ampak pomeni, da je čas, da se pregon mednarodnih kaznivih dejanj v večji meri prenese na nacionalna sodišča, ki bodo lahko hitreje in lažje rešila primere iz mednarodnokazenske materije. Pomemben korak k uspešnejšemu nacionalnemu pregonu predstavlja tudi Ljubljansko-haaška konvencija. Sklepno je ugotovljeno, da je v zadnjem stoletju prišlo do velikega napredka na področju mednarodnega kazenskega prava in pregona poveljnikov in drugih nadrejenih in da bo razvoj mednarodnega kazenskega prava še naprej ključnega pomena, dokler se bo svet spopadal z najhujšimi oblikami zločinov.

Title:Criminal Liability of Commanders and Other Superiors for International Criminal Acts under the Rome Statute
Abstract:International crimes are the most serious offences, affecting not only individuals as victims but also society as a whole and the system in which they were committed. They pose a particular challenge for law enforcement authorities at the national level, as national investigators and prosecutors face a range of complex factual and legal issues in such cases. At the forefront is the International Criminal Court, which was established with the aim of preventing impunity and acts as a court of last resort, intervening only when national legal systems are unable or unwilling to investigate and prosecute perpetrators of international crimes. From the outset, it was clear that the ICC’s prosecutions would focus on the most responsible perpetrators, namely commanders and leaders. This master’s thesis examines the international criminal liability of commanders and other superiors for international criminal acts under the Rome Statute. The prosecution of individuals, particularly heads of state, for international crimes faces political, legal, and practical obstacles. Special emphasis is placed on this issue in the thesis. It also discusses key case law of international criminal courts, new mechanisms of international cooperation, and reflections on the future of prosecuting international crimes. The analysis shows that the future of international criminal law lies at the national level and that this provides a solution for a more effective prosecution of commanders and other superiors. This does not mean that the International Criminal Court will no longer be necessary, but rather that it is time for the prosecution of international crimes to be transferred to a greater extent to national courts, which will be able to resolve cases involving international criminal matters more quickly and easily. The Ljubljana–Hague Convention also represents an important step towards more successful national prosecution. In conclusion, it has been established that significant progress has been made over the past century in the field of international criminal law and in the prosecution of commanders and other superiors, and that the further development of international criminal law will continue to be of key importance as long as the world is confronted with the most serious forms of crime.
