Title:Kaznivo dejanje umora v povezavi z neprištevnostjo ter analiza sodne prakse : magistrsko delo

Abstract:Kaznivo dejanje umora predstavlja eno najhujših kaznivih dejanj zoper življenje in telo, saj gre za hud in nepopravljiv poseg v človeško življenje. Pomen in resnost tega kaznivega dejanja se odražata v visoko predpisanih kaznih. Zaradi teže kaznivega dejanja sta odmera kazni in presoja osebnih okoliščin storilca eno ključnih vprašanj tako sodne prakse kot tudi teorije. Pri presoji kaznivega dejanja umora imajo odločilno vlogo vprašanja (ne)prištevnosti, zahrbtnosti in grozovitosti dejanja, saj ti dejavniki bistveno vplivajo bodisi na obstoj krivde bodisi na višino in vrsto kazenske sankcije. Magistrska naloga raziskuje, kako sodna praksa in teorija pristopata k presoji teh elementov, pri čemer posebej obravnava zahrbtnost in grozovitosti dejanja. Delo izpostavlja tudi vlogo sodnopsihiatričnih izvedencev pri ugotavljanju (ne)prištevnost. Natančna določitev prisotnosti zahrbtnosti in grozovitosti je ključna, saj ti kvalifikatorni okoliščini vplivata na oblikovanje kazenske sankcije. Pomemben poudarek je tudi sodiščih, ki tehtajo izvedenske ugotovitve, celovito presojajo motivacijo, način izvršitve ter posledice dejanja ter uravnavajo obteževalne in olajševalne okoliščine. Sodišča stremijo k izreku pravične in hkrati najstrožje možne kazni, s čimer zagotavljajo skladnost s pravno teorijo in sodno prakso. Poglobljeno razumevanje kaznivega dejanja umora, vključno s pomenom zahrbtnosti, grozovitosti in (ne)prištevnosti, prispeva k boljšemu razumevanju odločanja v najzahtevnejših primerih kazenskega prava in k razvoju pravne teorije o najhujših kaznivih dejanjih.

Title:The criminal offense of murder in the context of legal insanity and an analysis of judicial practice
Abstract:The criminal offence of murder represents one of the most serious crimes against life and body integrity, as it constitutes a severe and irreversible interference with human life. The significance of this offence is reflected in the high penalties. Due to the seriousness of the crime, the determination of the sentence and the assessment of the perpetrator ’s personal circumstances are key issues in both judicial practice and legal theory. In assessing the crime of murder, crucial factors include the (non)insanity of the perpetrator, premeditation, and the atrocity of the act, as these elements significantly influence both the existence of guilt and the severity and type of punishment. This master’s thesis examines how judicial practice and legal theory approach the assessment of these elements, with particular focus on premeditation and the atrocity of the act. The study also highlights the role of forensic psychiatric experts in determining (non)insanity. The precise determination of premeditation and atrocity is essential, as these qualifiers directly impact the formulation of the criminal penalty and are reflected in the high statutory sanctions. Attention is also given to the weighing of expert findings and the comprehensive assessment of the perpetrator’s motivation, the manner of execution, and the consequences of the act, while courts balance aggravating and mitigating circumstances. Courts aim to impose sentences that are fair and at the same time the most severe possible, thereby ensuring consistency with legal theory. A thorough understanding of the criminal offence of murder, including the significance of premeditation, atrocity, and (non)insanity, contributes to a better understanding of judicial decision-making in the most challenging cases of criminal law and to the development of legal theory concerning the gravest crimes.
