Title:Incoterms in pomorsko piratstvo: interakcija pravnih določil in varnostnih tveganj : magistrsko delo

Abstract:Magistrsko delo obravnava povezavo med pravili Incoterms in pomorskim piratstvom ter analizira, kako pravna določila o prenosu tveganja in stroškov delujejo v razmerah povečanih varnostnih groženj v mednarodni trgovini. Cilj dela je ugotoviti, v kolikšni meri pomorsko piratstvo vpliva na zamude in motnje v oskrbovalnih verigah, ter presoditi, ali pravila Incoterms v takšnih razmerah zagotavljajo zadostno razmejitev odgovornosti med pogodbenimi strankami. Raziskava temelji na kvalitativnem pristopu, ki vključuje sistemski metodološki pregled literature, računalniško podprto vsebinsko analizo z orodjem Leximancer in empirične vpoglede iz mini fokusnih skupin v štirih anonimiziranih podjetjih v Sloveniji (A, B, C in D). Ugotovitve kažejo, da povečana varnostna tveganja povzročajo podaljšanje dobavnih rokov, spremembe transportnih poti, rast stroškov prevoza ter večjo potrebo po zavarovanju in prilagoditvah upravljanja zalog. Hkrati se izkaže, da Incoterms ne urejajo varnostnih tveganj kot takih, temveč primarno določajo točko prenosa tveganja in stroškov, zato učinkovito obvladovanje posledic piratstva zahteva dopolnilne pogodbene dogovore, ustrezno zavarovalno kritje ter proaktivno upravljanje oskrbovalnih verig. Delo ob tem izpostavi raziskovalno vrzel na presečišču pravnega in logističnega vidika obravnave piratstva ter nudi empirično podprte usmeritve za prakso.

Title:Incoterms and maritime piracy: interaction between legal provisions and security risk
Abstract:This master’s thesis examines the relationship between Incoterms rules and maritime piracy, analysing how legal provisions on the transfer of risk and costs operate under heightened security threats in international trade. The aim of the thesis is to determine to what extent maritime piracy contributes to delays and disruptions in supply chains and to assess whether Incoterms provide a sufficient allocation of responsibilities between contracting parties under such conditions. The study adopts a qualitative approach combining a systematic methodological literature review, computer-assisted content analysis using Leximancer, and empirical insights from mini focus groups conducted in four anonymised large companies in Slovenia (Companies A, B, C and D). The findings indicate that increased security risks lead to longer lead times, rerouting of transport flows, higher freight costs, and a greater need for insurance coverage and inventory-management adjustments. At the same time, Incoterms do not regulate security risks as such; rather, they primarily define the point at which risk and costs are transferred. Consequently, effective mitigation of piracy-related impacts requires supplementary contractual arrangements, appropriate insurance solutions, and proactive supply chain risk management. The thesis also highlights a research gap at the intersection of legal and logistics perspectives on maritime piracy and provides empirically grounded implications for practice.
