Title:Protiustavnost politične stranke v slovenski ustavni ureditvi

Abstract:Avtor obravnava slovensko ustavnopravno ureditev izrekanja omejevalnih ukrepov zoper politične stranke po 68. členu Zakona o ustavnem sodišču (ZUstS). Ta določa izključno pristojnost Ustavnega sodišča za presojo protiustavnosti aktov in delovanja političnih strank ter za odreditev njihovega izbrisa iz registra političnih strank. Podrobno so analizi-rani procesni elementi ter vsebinska merila, ki jih je oblikovalo Ustavno sodišče, vključno z zahtevo obstoja posebej kvalificirane grožnje demokratični ureditvi. Prispevek pokaže, da slovenska ureditev na eni strani sledi nemškemu modelu, hkrati pa od njega na več mestih pomembno odstopa. Tako določa zelo širok nabor subjektov, ki lahko sprožijo postopek za presojo protiustavnosti aktov ali delovanja politične stranke, hkrati pa ne vsebuje zakonskih določb o učinkih izbrisa parlamentarne stranke iz registra, kar se v praksi lahko pokaže kot problematično. Primerjalnopravni okvir (Nemčija, ESČP) služi kot ozadje za kontekstualizacijo in kritično vrednotenje slovenske ureditve. Avtor odgo-varja na raziskovalno vprašanje, kakšne so značilnosti postopkov po 68. členu ZUstS v Republiki Sloveniji. S tem si prizadeva zapolniti vrzel v teoretičnih razpravah, kjer je bilo to vprašanje doslej spregledano.

Title:Unconstitutionality of a political party in the Slovenian constitutional system
Abstract:The article focuses on the Slovenian constitutional framework for imposing restrictive measures against political parties under Article 68 of the Constitutional Court Act. This provision grants exclusive jurisdiction to the Constitutional Court to assess the uncon-stitutionality of political party acts and conduct, and to order their removal from the register of political parties. The article provides a detailed analysis of the procedural ele-ments and substantive criteria developed by the Constitutional Court, including the requirement of a specially qualified threat to the democratic order. It shows that while the Slovenian model draws on the German approach, it also significantly diverges in key areas, particularly in allowing a broad range of initiators and in lacking clear legal provisions on the consequences of banning a parliamentary party, which may prove problematic in practice. The comparative legal framework (Germany, ECtHR) serves as a background for contextualizing and critically evaluating the Slovenian system. The article addresses the research question: “What are the characteristics of the procedures under Article 68 of the Constitutional Court Act in the Republic of Slovenia?” In doing so, it seeks to fill a gap in legal scholarship, where this issue has often been overlooked despite its relevance to one of the core constitutional dilemmas of modern democracy.
