Title:Problem sugestibilnosti v preiskovalnih intervjujih : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Diplomsko delo obravnava problem sugestibilnosti v preiskovalnih intervjujih ter njen vpliv na zanesljivost in verodostojnost informacij v kazenskopravnih postopkih. V ospredju je razumevanje preiskovalnega intervjuja kot informacijsko usmerjenega procesa, ki se bistveno razlikuje od zaslišanja, zlasti glede ciljev, vloge izpraševalca in stopnje pritiska na intervjuvanca. V teoretičnem delu so predstavljeni psihološki in kognitivni dejavniki, ki vplivajo na sugestibilnost, med njimi stres, psihološki pritisk, vpliv avtoritete, način spraševanja ter značilnosti spominskega priklica. Poseben poudarek je namenjen ranljivim skupinam, predvsem otrokom, ki so zaradi razvojnih značilnosti, čustvene občutljivosti in odnosa do avtoritete bolj dovzetni za sugestivne vplive v preiskovalnih postopkih. V nadaljevanju so obravnavane metode za zmanjševanje sugestibilnosti v praksi, s poudarkom na kognitivnem intervjuju, aktivnem poslušanju in uporabi odprtih vprašanj. Analizirana je tudi vloga usposabljanja preiskovalcev ter problematika zanašanja na neverbalne znake pri presoji verodostojnosti izjav. Posebna pozornost je namenjena primerjavi Reidove tehnike in modela PEACE (tehnika preiskovalnega intervjuja), pri čemer je izpostavljeno, da sodobni, ne-konfrontacijski in etično utemeljeni pristopi zmanjšujejo tveganje sugestibilnosti in lažnih priznanj. Ugotovitve diplomskega dela poudarjajo, da zmanjševanje sugestibilnosti zahteva strokoven, nevtralen in etično voden preiskovalni intervju, ki temelji na kritičnem razmišljanju izpraševalca in spoštovanju intervjuvanca, kar je ključno za zagotavljanje pravičnosti in zanesljivosti kazenskih postopkov.

Title:The issue of suggestibility in investigative interviews
Abstract:This bachelor’s thesis examines the issue of suggestibility in investigative interviews and its impact on the reliability and credibility of information obtained in criminal justice proceedings. The focus is on understanding the investigative interview as an information-gathering process that differs significantly from interrogation, particularly in terms of its objectives, the role of the interviewer, and the level of pressure placed on the interviewee. The theoretical part presents psychological and cognitive factors that influence suggestibility, including stress, psychological pressure, the influence of authority, questioning techniques, and characteristics of memory retrieval. Special attention is given to vulnerable groups, especially children, who are more susceptible to suggestive influences in investigative procedures due to their developmental characteristics, emotional sensitivity, and relationship to authority. The thesis further addresses methods for reducing suggestibility in practice, with an emphasis on the cognitive interview, active listening, and the use of open-ended questions. The role of interviewer training and the issue of reliance on non-verbal cues in assessing statement credibility are also examined. Particular attention is paid to the comparison between the Reid Technique and the PEACE model, highlighting that contemporary, non-confrontational, and ethically grounded approaches reduce the risk of suggestibility and false confessions. The findings of the thesis emphasize that reducing suggestibility requires a professional, neutral, and ethically conducted investigative interview based on the interviewer’s critical thinking and respect for the interviewee, which is essential for ensuring fairness and reliability in criminal justice proceedings.
