Abstract:Vloga in legitimnost (mednarodno delujočih) zagovorniških nevladnih organizacij (NVO) sta vse pogosteje pod drobnogledom, zlasti v kontekstih, kjer njihova prizadevanja za vplivanje na javno mnenje in politiko izzivajo obstoječe strukture moči. Te organizacije, ki pogosto delujejo kot posredniki med državljani in državnimi institucijami, lahko igrajo ključno vlogo pri spodbujanju človekovih pravic, demokratičnih vrednot in odgovornosti oblasti. V zadnjih letih je vse več vlad sprejelo omejevalne pravne ukrepe – kot so zakoni o »tujih agentih« – ki naj bi sicer formalno krepili transparentnost, v praksi pa lahko služijo stigmatizaciji in nadzoru civilne družbe. Predstavljena je primerjalna analiza Zakona o registraciji tujih agentov (FARA) v Združenih državah Amerike in podobnega zakona v Republiki Srbski, s katero se osvetljuje, kako se sorodni pravni mehanizmi lahko uporabljajo različno glede na politični in družbeni kontekst. Pozornost je namenjena tudi finančni ranljivosti NVO, zlasti tistih, ki so odvisne od zunanjih virov, saj to lahko vodi do sprememb v prioritetah in ogrozi njihovo integriteto. Skozi to prizmo so kritično preučeni učinki omejevalne zakonodaje na delovanje in verodostojnost NVO.

Title:Foreign Agents Act: A Comparison of the US and Republika Srpska cases : diplomsko delo univerzitetnega študijskega programa Varstvoslovje
Abstract:The role and legitimacy of internationally active advocacy non-governmental organizations (NGOs) have increasingly come under scrunity, particularly in contexts where their efforts to influence public opinion and policy challenge established power structures. Often positioned as intermediaries between citizens and state institutions, these organizations can play a key role in promoting human rights, democratic values and government accountability. In recent years, however, a growing number of governments have adopted restrictive legal measures – such as »foreign agent« laws – that, while formally introduced to enhance transparency, can be used to stigmatize and control civil society. A comparative analysis of the Foreign Agents Registration Act (FARA) in the United States and a similar law in Republika Srpska is presented to illustrate how related legal mechanisms can be employed differently depending on political and social context. Attention is also given to the financial vulnerabilities of NGOs, particularly those reliant on external funding, which can lead to shifts in priorities and challenges to their integrity. Through this lens, the implications of restrictive legislation for the functioning and credibility of NGOs are critically examined.
