Title:Litispendenca in sorodne pravde : magistrsko delo

Abstract:Litispendenca in sorodne pravde predstavljajo osrednja mehanizma za preprečevanje vzporednih postopkov in nezdružljivih sodnih odločb v evropskem civilnem procesnem pravu. Vzporedni postopki, ki pogosto nastanejo zaradi taktičnih ravnanj strank, pomenijo resno tveganje za pravno varnost, predvidljivost sodnega varstva in učinkovito delovanje sodnih sistemov znotraj EU. Kadar o istem ali tesno povezanem pravnem vprašanju hkrati odločata dve sodišči različnih držav članic, se poveča tveganje za izdajo nezdružljivih sodb. Evropski zakonodajalec je zato vzpostavil mehanizme za usklajevanje pristojnosti, danes urejene predvsem v Uredbi 1215/2012. Temeljni cilj ureditve je s preprečevanjem izdaje nezdružljivih sodb v različnih državah članicah EU omogočiti prost pretok sodnih odločb ter tako zagotoviti materialno usklajenost med pravnimi rešitvami, ki se tradicionalno dosega s priznavanjem in izvrševanjem tujih sodb. Litispendenca je institut, namenjen preprečevanju vzporednih postopkov med istimi strankami o istem zahtevku. Gre za negativno procesno predpostavko, katere obstoj preprečuje dopustnost začetka nove pravde ter meritorno odločanje o sporu. Urejena je v členu 29 Uredbe 1215/2012, ki vzpostavlja strogo pravilo prednosti, po katerem ima v primeru konflikta dveh identičnih postopkov prednost za obravnavo zadeve sodišče, ki je postopek začelo prvo. Da se pravilo prednosti sploh lahko uporabi, morajo biti vzpostavljeni pogoji za uporabo pravil o litispendenci, ki jih je skozi sodno prakso razvilo Sodišče EU. Podana mora biti trojna identiteta spora, in sicer identiteta strank, identiteta predmeta spora ter identiteta podlage. Za razliko od litispendence sorodne pravde, urejene v členu 30 Uredbe 1215/2012, ne temeljijo na identičnosti postopkov, temveč uvajajo nabor pravil, ki se uporabljajo v primerih, ko pogoji za litispendenco niso izpolnjeni. Gre za situacije, v katerih sta dve pravdi med seboj tako tesno povezani, da je njuna skupna obravnava smotrna, da se prepreči tveganje nezdružljivih sodb, ki bi lahko nastale, če bi se obravnavali ločeno. Oba člena si torej prizadevata preprečiti situacije, v katerih bi sodišča različnih držav članic izdala nasprotujoče si in potencialno nezdružljive sodbe, vendar pa člen 30 zasleduje širši cilj in to počne z namenom spodbujanja pravilnega izvajanja sodne oblasti ter enotnega delovanja nacionalnih sistemov v EU. Iz tega izhaja, da je nezdružljive sodbe treba preprečiti ne le zato, ker ovirajo postopke vzajemnega priznavanja sodb, temveč tudi zato, ker je neskladnost sama po sebi nezdružljiva z evropskim procesnim sistemom.

Title:Lis pendens and related actions
Abstract:Lis pendens and related actions represent the central mechanisms for preventing parallel proceedings and irreconcilable judgements in European civil procedural law. Parallel proceedings, which often arise from tactical reasons of the parties, pose a serious risk to legal certainty, the predictability of judicial protection, and the efficient functioning of judicial systems within EU. When two courts of different Member States simultaneously decide on the same or a closely connected legal matter, the risk of issuing conflicting judgements increases. The European legislator has therefore established mechanism for coordinating jurisdiction, now primarily regulated in Regulation 1215/2012. The fundamental aim of this framework is to prevent the issuance of irreconcilable judgements in different EU Member States, thereby enabling the free movement of judgements and ensuring material consistency between legal solutions, which is traditionally achieved through the recognition and enforcement of foreign judgements. Lis pendens is an institute designed to prevent parallel proceedings between the same parties concerning the same claim. It constitutes a negative procedural prerequisite, the existence of which precludes the admissibility of initiating a new action and prevents a court from deciding on the merits. It is regulated in Article 29 of Regulation 1215/2012, which establishes a strict rule of priority, under which in the event of a conflict between two identical proceedings, the court first seized has priority to hear the case. For the rule of priority to apply, the conditions for lis pendens must be met, as developed through the case law of the Court of Justice of the EU. A triple identity of the dispute must be present – identity of the parties, identity of the subject and identity of the cause of action. In contrast to lis pendens, related actions, regulated in Article 30 of Regulation 1215/2012, do not rely on the identity of the proceedings, but introduce a set of rules applicable in situations where the conditions for lis pendens are not fulfilled. These are the cases in which two actions are so closely connected that it is expedient to hear and determine them together in order to avoid the risk of irreconcilable judgements. However, Article 30 pursues a broader objective and does so with the aim of promoting the proper administration of justice and the coherent functioning of national judicial systems within the EU. It follows that irreconcilable judgements must be prevented not only because they hinder the operation of mutual recognition of judgements, but also because inconsistency itself is incompatible with the European procedural system.
