Abstract:V magistrski nalogi je podrobno analiziran institut proizvajalčeve razširjene odgovornosti (v nadaljevanju PRO) v slovenski zakonodaji. PRO je institut okoljskega prava, ki povezuje zasebnopravno odgovornost in javnopravno ureditev, saj gre za obveznost gospodarskih subjektov, ki delujejo na trgu. Na drugi strani mora država, kot zakonodajalec to obveznost s pravili javnega prava urejati, saj zasleduje javni interes. Ker je uresničevanje tega koncepta EU prepuščen državam, je v praksi značilna raznolikost nacionalnih ureditev. Naloga obravnava razvoj slovenskega sistema PRO na področju ravnanja z odpadki, ki se je zaradi izkazanih pomanjkljivosti moral spremeniti. Osrednja tema naloge je presoja skladnosti nove ureditve po ZVO-2 s pravom EU, ki uvaja sistem monopolnega nepridobitnega izvajanja dejavnosti PRO, ter razmerje javnega interesa in trga. Temeljne svoboščine notranjega trga, predvsem svoboda ustanavljanja in prost pretok storitve, ter zakoniti cilji varstva okolja, ki jih zasledujejo države članice v javnem interesu, izhajajo iz primarnega prava EU, pri čemer morajo države članice zasledovati in uresničevati oba cilja. Osrednji del naloge je zato namenjen analizi sodbe Sodišča EU v zadevi (C-254/23) INTERZERO, ki je bila Sodišču EU predložena na podlagi predhodnega vprašanja Ustavnega sodišča Republike Slovenije, in predstavlja pomembno prelomnico v razumevanju razmerja med javnim interesom in trgom v pravu EU. Iz sodbe izhaja, da kadar država zasleduje cilje v javnem interesu, pravo EU ne zagotavlja neomejenega dostopa do trga. Ukrepi za dosego teh ciljev morajo biti sorazmerni, nediskriminatorni in transparentni, tako da je državam članicam priznana široka prosta presoja pri izbiri instrumentov za uresničevanje okoljskih ciljev. Iz tega sledi, da sama ureditev PRO v ZVO-2 ni neskladna s pravom EU. Ustavnemu sodišču je bila naložena presoja omejitev, ki veljajo za gospodarske subjekte zavezane po ZVO-2 glede obveznosti PRO, v okviru in ob upoštevanju razlage, ki jo je podalo SEU v zadevi INTERZERO.

Title:Between public interest and market: the legal framework of a unified waste management organisation in the light of EU law : magistrsko delo
Abstract:This thesis provides a detailed analysis of the extended producer responsibility (in the following text: EPR) scheme within Slovenian legislation. EPR is an environmental law instrument that links private law liability with public law regulation, as it establishes obligations for producers active on the market. A member state, as the legislator pursuing public interest objectives, is required to regulate these obligations through public law instruments. Since the implementation of this EU concept is left to the discretion of the member states, there are many differences in national systems. The thesis examines the development of the Slovenian EPR system in the field of waste management, which had to be amended due to some of the identified inadequacies. The central focus of the thesis is the assessment of the compatibility of the new arrangement in ZVO-2 with EU law. This arrangement introduces a system of monopoly, non-profit implementation of EPR obligations, and examines the relationship between public interest in environmental law. The fundamental freedoms of the internal market, in particular the freedom of economic initiative and the freedom to provide services, as well as the legitimate environmental protection objectives pursued by member states in the public interest, derive from primary EU law. Member states are required to pursue and implement both sets of objectives simultaneously. The central part of the thesis is therefore meant for the analysis of the Court of justice of the EU judgment in case (C-254/23) INTERZERO, which was referred to the Court on the basis of a preliminary ruling requested by the Constitutional court of the Republic of Slovenia, and represents an important milestone in understanding the relationship between public interest and the market under EU law. The judgment confirms that, when a member state pursues public interest, EU law does not guarantee unrestricted access to the market. However, measures adopted to achieve public interests must be proportionate, non-discriminatory, and transparent. The EPR framework established with ZVO-2 is therefore not incompatible with EU law. The Constitutional court of the Republic of Slovenia was tasked with assessing whether the restrictions imposed on economic operators performing EPR obligations under ZVO-2 comply with the interpretation provided by the Court of justice of the EU in the INTERZERO case.
