Title:Posegi v človekove pravice in temeljne svoboščine pri opravljanju detektivske dejavnosti : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Prekomerno ali nedovoljeno poseganje v človekove pravice predstavlja pomemben družbeni problem, ki se pojavlja tudi pri detektivski dejavnosti. Obdelava in zbiranje osebnih podatkov povečuje tveganje za kršitve, še posebej pravice do zasebnosti. Teoretični del diplomske naloge obravnava temeljne pojme človekovih pravic, njihovo pravno podlago, ter zakonsko ureditev detektivske dejavnosti v Republiki Sloveniji. Poudarek je na omejitvah pooblastil, nadzoru in institucijah za zaščito pravic posameznika. Empirični del temelji na anketnem vprašalniku, v katerem smo skušali ugotoviti pogostost prekomernega ali nedovoljenega poseganja v človekove pravice, detektivske naloge, pri katerih je tveganje za kršitve največje ter vrste pravic, v katere se največkrat posega. Vzorčni okvir raziskave predstavlja 92 detektivov, vzorec pa 19 detektivov, ki so se odzvali. Rezultati raziskave so pokazali, da detektivi najpogosteje opravljajo naloge povezane z zbiranjem informacij o zlorabah pravice do zadržanosti z dela zaradi bolezni ali poškodbe, pri čemer zaznavajo tudi največje poseganje v posameznikove pravice. Kot najpogosteje izpostavljena pravica se pojavlja pravica do zasebnosti in osebnostnih pravic. Večina anketiranih ocenjuje, da je zakonodaja na področju detektivske dejavnosti in drugih pravnih področjih, povezanih z varstvom človekovih pravic v Republiki Sloveniji dobro in ustrezno urejena.

Title:Interference with human rights and fundamental freedoms in the conduct of detective work
Abstract:Excessive or unauthorized interference with human rights is a significant social problem that also occurs in the field of the private investigation. Processing and collecting personal data increases the risk of breaches, especially the right to privacy. The theoretical part of the thesis discusses the fundamental concepts of human rights, their legal basis, and the legal regulation of private investigation activities in the Republic of Slovenia. The focus is on limitations of powers, control, and institutions for protecting individual rights. The empirical part is based on a survey questionnaire, in which we tried to determine the frequency of excessive or unauthorized interference with human rights, private investigation tasks where the risk of violations is greatest, and the types of rights that are most often interfered with. The sampling frame of the research includes 92 private investigators, while the sample comprise 19 private investigators who responded to the survey. The results of the research showed that private investigators most often perform tasks related to gathering information about violations of the right to sick leave owing to illness or injury, and they also detect the greatest interference with individual rights. The right to privacy and personal rights appears as the most frequently exposed right. Most respondents believe that the legislation in the field of private investigation activities and other legal areas related to the protection of human rights in the Republic of Slovenia is well and appropriately regulated.
