Title:Primerjalna analiza uporabe prisilnih sredstev v policiji in pravosodni policiji v Sloveniji : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu je obravnavana uporaba prisilnih sredstev v policiji in pravosodni policiji ter izvedena primerjalna analiza njune uporabe. Čeprav se naloge, pristojnosti in organizacijska struktura obeh organov razlikujejo, ju povezuje skupna potreba po uporabi prisilnih sredstev za zagotavljanje varnosti, vzdrževanje javnega reda in učinkovito izvajanje zakonsko določenih nalog. Pojem prisilnega sredstva je v slovenskem pravnem redu opredeljen kot skupek ukrepov, s katerimi pooblaščene uradne osebe vplivajo na ravnanje posameznika, bodisi tako, da ga k določenemu ravnanju prisilijo bodisi mu takšno ravnanje preprečijo (Žaberl, 2009). Njihova uporaba je za policijo urejena v Zakonu o nalogah in pooblastilih policije (ZNPPol, 2013), za pravosodno policijo pa v Zakonu o izvrševanju kazenskih sankcij (ZIKS-1, 2000) ter pripadajočih podzakonskih aktih. Uporaba prisilnih sredstev je dopustna zgolj v primerih, ko je njihova uporaba nujna za dosego zakonitega cilja, pri čemer morajo biti spoštovana načela sorazmernosti, zakonitosti in subsidiarnosti (United Nations, 1990). V diplomskem delu so analizirana zakonska pooblastila, vrste prisilnih sredstev, pogoji in okoliščine njihove uporabe ter postopki poročanja o izvedenih ukrepih v obeh organih. Poseben poudarek je namenjen statistični primerjavi uporabe prisilnih sredstev v zadnjih petih letih, razlikam v poročanju ter presoji strokovne usposobljenosti izvajalcev. Rezultati analize omogočajo celovit vpogled v podobnosti in razlike med policijo in pravosodno policijo ter prispevajo k boljšemu razumevanju zakonitosti, učinkovitosti in nadzora nad uporabo prisilnih sredstev v praksi.

Title:A Comparative Analysis of the Use of Coercive Measures by the Slovenian Police and Prison Service
Abstract:The thesis examines the use of coercive measures in the police and the judicial police, with a focus on a comparative analysis of their application. Although the competences, responsibilities, and organizational structures of the two institutions differ, both rely on coercive measures to ensure security, maintain public order, and effectively perform legally prescribed tasks. In the Slovenian legal system, coercive measures are understood as actions through which authorized officials influence an individual’s conduct, either by compelling certain behaviour or preventing it (Žaberl, 2009). Their use is regulated for the police by the Police Tasks and Powers Act (ZNPPol, 2013), while for the judicial police it is governed by the Enforcement of Criminal Sanctions Act (ZIKS-1, 2000) and related secondary legislation. The use of coercive measures is permitted only in cases where their application is necessary to achieve a lawful objective, and it must comply with the principles of proportionality, legality, and subsidiarity (United Nations, 1990). The thesis analyzes legal authorizations, types of coercive measures, conditions and circumstances of their use, as well as reporting procedures in both institutions. Particular emphasis is placed on the statistical comparison of the use of coercive measures over the past five years, differences in reporting practices, and the assessment of the professional competence of officials. The findings provide a comprehensive insight into the similarities and differences between the police and the judicial police and contribute to a better understanding of the legality, effectiveness, and supervision of the use of coercive measures in practice.
