Title:Meje medijskega poročanja v kazenskih postopkih z vidika svobode izražanja, zasebnosti in poštenega sojenja : magistrsko delo

Abstract:V magistrskem delu obravnavam meje medijskega poročanja v kazenskih postopkih ter razmerje med svobodo izražanja medijev na eni strani in varstvom pravic posameznika na drugi strani, zlasti pravice do poštenega sojenja, domneve nedolžnosti ter pravice do zasebnosti in osebnostnih pravic. Svoboda izražanja je temeljna človekova pravica in ključen pogoj demokratične družbe, saj omogoča obveščenost javnosti in nadzor nad delovanjem oblasti. Vendar ta pravica ni absolutna in je omejena z varstvom drugih pravic oseb, ki se znajdejo v kazenskem postopku, predvsem pa z interesom zagotavljanja poštenega kazenskega postopka. Analiza pokaže, da medijsko poročanje o kazenskih zadevah predstavlja izrazito konfliktno področje, kjer prihaja do kolizije med pravico javnosti do obveščenosti in pravicami oseb, vpletenih v kazenski postopek. Posebej problematično je poročanje v zgodnjih, nejavnih fazah kazenskega postopka, kjer je dokazni standard nizek, tveganje za poseg v domnevo nedolžnosti in zasebnost pa največje. Neupravičeno ali senzacionalistično poročanje lahko povroči trajne posledice za posameznika in hkrati ogrozi samo poštenost postopka. Na podlagi obsežne sodne prakse slovenskih sodišč, zlasti pa sodne prakse Evropskega sodišča za človekove pravice so se oblikovali ključni kriteriji za tehtanje kolidirajočih pravic, med katerimi izstopajo prispevek k objavi v javnem interesu, položaj in prepoznavnost osebe, faza kazenskega postopka, teža kaznivega dejanja ter metode pridobivanja informacij in sama predstavitev teh informacij medija. Ugotovljeno je, da svoboda izražanja ne uživa absolutne prednosti, temveč je podvržena strogi presoji testa sorazmernosti v okviru katerega se skozi okoliščine konkretnega primera opravi sinteza primera skozi posamezna merila tehtanja. V delu sem nadalje izpostavil, da slovenski pravni red zagotavlja več procesnih mehanizmov za varstvo poštenosti kazenskega postopka pred medijskimi vplivi, kot so izločitev sodnika, prenos krajevne pristojnosti, izključitev javnosti ter omejitve snemanja in obveščanja o glavnih obravnavah.

Title:Limits of media reporting in criminal proceedings from perspective of freedom of expression, privacy and the right to a fair trial
Abstract:In my master's thesis, I address the limits of media reporting in criminal proceedings and the relationship between freedom of expression on the part of the media and the protection of individual rights, in particular the right to a fair trial, the presumption of innocence, and the right to privacy and personality rights. Freedom of expression is a fundamental human right and a key prerequisite of a democratic society, as it enables public awareness and oversight of the functioning of state authorities. However, this right is not absolute and is limited by the protection of the rights of individuals involved in criminal proceedings, as well as by the interest in ensuring a fair criminal process. The analysis demonstrates that media reporting on criminal matters represents a highly conflict-prone area, where a collision arises between the public’s right to be informed and the rights of individuals involved in criminal proceedings. Reporting is particularly problematic in the early, non-public stages of criminal proceedings, where the evidentiary threshold is low and the risk of interference with the presumption of innocence and the right to privacy is the highest. Unjustified or sensationalist reporting may cause lasting consequences for the individual and may at the same time jeopardize the fairness of the proceedings. Based on extensive case law of Slovenian courts, and in particular the case law of the European Court of Human Rights, key criteria for balancing competing rights have been developed. These include the contribution of the publication to a matter of public interest, the status and notoriety of the person concerned, the stage of the criminal proceedings, the seriousness of the offence, as well as the methods of obtaining and presenting information by the media. It has been established that freedom of expression does not enjoy absolute precedence, but is subject to a strict proportionality test, within which a case-specific assessment is carried out by weighing all relevant criteria. In the thesis, I further highlighted that the Slovenian legal system provides several procedural mechanisms for safeguarding the fairness of criminal proceedings against media influence, such as judicial recusal, transfer of territorial jurisdiction, exclusion of the public, and restrictions on recording and reporting from main hearings.
