Title:Primerjava zaporne kazni in alternativnih kazni : prednosti in izzivi

Abstract:V zaključnem delu se osredotočamo na analizo prednosti in slabosti zapornih kazni ter alternativnih sankcij. Osredotočili smo se na vprašanje, ali alternativne sankcije predstavljajo učinkovitejše kaznovanje na podlagi zmanjševanja povratništva in učinkovitejše rehabilitacije ter reintegracije storilcev kaznivih dejanj v družbo. V zaključnem delu je bila uporabljena metoda pregleda domače in tuje znanstvene literature. Ugotovitve kažejo, da zaporna kazen predstavlja pomembno sankcijo za hujša kazniva dejanja, saj z izolacijo storilca kaznivega dejanja iz družbe onemogoča ponovitev kaznivega dejanja in posledično prispeva k zagotavljanju varnosti prebivalcev. Hkrati ima omejen vpliv na zmanjševanje povratništva, uspešno rehabilitacijo in socialno vključenost, saj temelji na represivnem kaznovanju. Alternativne sankcije so v primerjavi z zapornimi kaznimi učinkovitejše pri zmanjševanju povratništva in povečujejo možnost ustrezne rehabilitacije storilcev kaznivih dejanj, saj temeljijo na ohranjanju stikov z družino in družbo, socialni vključenosti ter omogočajo izvajanje številnih terapevtskih programov, ki v zaporu niso na voljo. S finančnega vidika predstavljajo manj zahtevno obliko kaznovanja. Ključnega pomena za varno izvajanje alternativnih sankcij so varnostni mehanizmi, nadzor delovanja sankcij in ustrezno usposobljen kader. Ugotovitve so pokazale, da je za dolgoročno zmanjševanje povratništva storilcev kaznivih dejanj in zagotavljanja varnosti v družbi ključnega pomena uravnotežena uporaba zaporne kazni ter alternativnih sankcij

Title:Comparison of prison sentence and alternative sanctions: advantages and challenges
Abstract:In the thesis, we focus on analysing the advantages and disadvantages of imprisonment and alternative sanctions. The study addresses the question of whether alternative sanctions represent a more effective form of punishment in terms of reducing recidivism, as well as improving the rehabilitation and reintegration of offenders into society. The research is based on a review of domestic and foreign literature. The findings indicate that imprisonment represents an important sanction for serious crimes, as it prevents reoffending through the isolation of the offender and thereby contributes to ensuring public safety. However, it has a limited impact on reducing recidivism, successful rehabilitation, and social inclusion, as it is based on a repressive form of punishment. Alternative sanctions are, compared to imprisonment, more effective in reducing recidivism and increasing the likelihood of successful rehabilitation, as they are based on maintaining contact with family and society, promoting social inclusion, and enabling the implementation of numerous therapeutic programmes that are often not available in prison settings. From a financial perspective, they represent a less demanding form of punishment. The safe implementation of alternative sanctions requires effective safety mechanisms, proper supervision, and trained staff. The findings further suggest that a balanced use of imprisonment and alternative sanctions is essential for the long-term reduction of recidivism and ensuring public safety.
