Title:Jedrska energija v pravu EU s poudarkom na državni pomoči za proizvodne sisteme : magistrsko delo

Abstract:Jedrska energija je energija, ki se večinoma uporablja za proizvodnjo elektrike. V EU spada med vire energije, ki zagotavljajo stalno in zanesljivo oskrbo z energijo in je del energetske mešanice nekaterih držav članic. 194. člen PDEU določa med drugim, da države članice same določajo svoje vire energije. Energetska politika določa cilje in dolgoročne načrte za uresničitev le-teh, kjer je zaznanih več dejavnikov, ki vplivajo na potek razvoja, med drugim tudi trenutna agresija Rusije nad Ukrajino. Evropska zakonodaja ureja področje na podlagi PEU, PDEU in PESAE. Področja, ki jih ureja, so povezana v večini z jedrsko varnostjo, saj EU stremi k doseganju najvišjih standardov varnosti na svetu. To so varovanje zaradi nevarnosti pred ionizirajočim sevanjem, stresni testi za jedrske elektrarne, jedrska varnost jedrskih objektov, mednarodno sodelovanje, varstvo zdravja prebivalstva pred radioaktivnimi snovmi v vodi, uvoz po nezgodi v Černobilu ter ravnanje z radioaktivnimi odpadki in izrabljenim gorivom. Poudarek je na državnih pomočeh za proizvodne sisteme jedrske energije v EU. 107. člen PDEU ureja področje državnih pomoči. Načeloma določa prepoved državnih pomoči, hkrati pa v drugem in tretjem odstavku predvideva izjeme, pri čemer drugi odstavek določa primere pomoči, ki se štejejo za združljive z notranjim trgom, tretji odstavek pa določa primere pomoči, ki se lahko štejejo za združljive z notranjim trgom pod določenimi pogoji. V nadaljevanju sta predstavljeni sodni zadevi, povezani z državnimi pomočmi za proizvodne sisteme jedrske energije Hinkley Point C in Paks II.

Title:Nuclear energy in EU law with a focus on state aid for production systems
Abstract:Nuclear energy is energy that is mainly used for electricity production. In the EU, it is one of the energy sources that ensure a constant and reliable energy supply and is part of the energy mix of some Member States. Article 194 of the TFEU stipulates, among other things, that Member States determine their own energy sources. Energy policy sets goals and sets long-term plans for their implementation, where several factors are known to influence the course of development, including Russia's current aggression against Ukraine. European legislation regulates are as based on the TEU, TFEU and the Euratom Treaty. The areas it regulates are mostly related to nuclear safety, as the EU strives to achieve the highest safety standards in the world. These are protection against the dangers of ionizing radiation, stress tests for nuclear power plants, nuclear safety of nuclear facilities, international cooperation, protection of public health from radioactive substances in water, imports after the Chernobyl accident and management of radioactive waste and spent fuel. The emphasis is on state aid for nuclear energy production systems in the EU. Article 107 TFEU regulates the field of State aid. In principle, it lays down a prohibition of State aid, but at the same time provides for exceptions in the second and third paragraphs, with the second paragraph specifying the cases of aid which are considered compatible with the internal market and the third paragraph specifying the cases of aid which may be considered compatible with the internal market under certain conditions. The following are two court cases related to State support for the Hinkley Point C and Paks II nuclear power generation systems.
