Title:Pravni vidiki spletnega nasilja v partnerskih odnosih : magistrsko delo

Abstract:Magistrsko delo obravnava spletno nasilje v partnerskih odnosih kot sodobno obliko nasilja, ki se razvija z uporabo digitalnih tehnologij. Takšno nasilje se kaže v različnih oblikah, kot so nadzorovanje, nadlegovanje, širjenje intimnih vsebin brez privolitve, zloraba komunikacijskih orodij ter posegi v zasebnost. Pri tem ima zaradi stalne dosegljivosti, anonimnosti in hitrosti širjenja informacij posebne značilnosti. Te povečujejo intenzivnost, trajanje in razsežnost nasilja ter lahko povzročajo resne psihološke, socialne in ekonomske posledice za žrtve. Spletno nasilje se pogosto prepleta s tradicionalnimi oblikami nasilja in predstavlja nadaljevanje že obstoječih vzorcev nadzora in zlorabe v partnerskih odnosih. V slovenskem pravnem redu takšno ravnanje ni posebej opredeljeno, vendar se obravnava v okviru obstoječih institutov družinskega in kazenskega prava. Kljub temu pravna ureditev ne upošteva v zadostni meri posebnosti digitalnega okolja, zlasti glede razpršenosti ravnanj in trajnosti digitalnih sledi. V praksi se pojavljajo težave pri dokazovanju, razdrobljenost pristojnosti ter pomanjkanje specializiranega znanja in usklajenega institucionalnega pristopa. Posledično je pravno varstvo žrtev formalno zagotovljeno, vendar pogosto omejeno in manj učinkovito. Potrebne so nadaljnje prilagoditve zakonodaje in prakse, zlasti na področju jasnejše opredelitve pojavnih oblik, izboljšanja dokaznih mehanizmov ter krepitve odziva pristojnih institucij na nasilje v digitalnem okolju.

Title:Legal aspects of cyberviolence in partner relationships
Abstract:This master’s thesis addresses online violence in intimate partner relationships as a contemporary form of violence that develops through the use of digital technologies. Such violence manifests in various forms, such as monitoring, harassment, the dissemination of intimate content without consent, misuse of communication tools, and intrusions into privacy. Due to constant accessibility, anonymity, and the speed of information dissemination, it has specific characteristics that increase the intensity, duration, and scope of violence and may result in serious psychological, social, and economic consequences for victims. Online violence is often intertwined with traditional forms of violence and represents a continuation of existing patterns of control and abuse in intimate partner relationships. In the Slovenian legal system, such conduct is not specifically defined, but is addressed within the framework of existing institutions of family and criminal law. Nevertheless, the legal framework does not sufficiently take into account the specific features of the digital environment, particularly the dispersed nature of conduct and the persistence of digital traces. In practice, difficulties arise in evidence collection, fragmented institutional competencies, and a lack of specialized knowledge and a coordinated institutional approach. Consequently, the legal protection of victims is formally ensured, but often limited and less effective. Further adjustments to legislation and practice are necessary, particularly in the areas of clearer definitions of forms of conduct, improvement of evidentiary mechanisms, and strengthening the response of competent institutions to violence in the digital environment.
