Title:Zagotavljanje kakovosti forenzičnega procesa v slovenski policiji : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu smo predstavili forenzično znanost ter njena temeljna načela na katerih temelji forenzični proces v slovenski policiji, s poudarkom na vlogi Evropske mreže inštitutov za forenzične znanosti (ENFSI) in Nacionalnega forenzičnega laboratorija (NFL) pri zagotavljanju kakovosti v forenzičnem procesu. Forenzični proces, ki poteka na kraju kaznivega dejanja, je standardiziran niz korakov od prihoda prvega policista na kraj do izdelave strokovnega poročila. ENFSI, ki zagotavlja kakovost razvoja in izvajanja forenzičnih znanosti po vsej Evropi, na več načinov zagotavlja vzpostavitev učinkovitih ukrepov za nadzor in zagotavljanje kakovosti v forenzičnem procesu. Spodbuja pridobitev akreditacije članic ENFSI, vzpostavitev delovne prakse, preizkuse usposobljenosti za strokovnjake, vzpostavitev sistema vodenja kakovosti, ustrezno kakovost opreme in materialov, vzpostavitev sistemov za preprečevanje kontaminacije. NFL, ki je edini slovenski akreditiran preizkuševalni laboratorij po standardu SIST EN ISO/IEC 17025, zagotavlja zanesljivost svojih preiskav z vpeljanim sistemom vodenja za obseg laboratorijskih aktivnosti, ki obsega 28 metod oziroma postopkov skladnih z navedenim standardom in sicer z nepristranskim delovanjem, s standardiziranimi in sledljivimi postopki, s strokovno usposobljenimi strokovnjaki, z uporabo sodobne vzdrževane opreme, izvajanjem notranjih kontrol kakovosti dela idr. NFL je pristojen tudi zato, da so policisti in kriminalistični tehniki usposobljeni in opremljeni. V ta namen so pripravili navodila za zavarovanje materialnih sledi, ki so usklajena z navodili ENFSI. Iz diplomskega dela je razvidno, da se sistem upravljanja kakovosti ne začne šele v laboratoriju, temveč je vključen že v fazo priprave prihoda na kraj ter v nadaljevanju v fazo ogleda kraja dejanja. Ogled kraja ni zgolj le nujno, enkratno, neponovljivo, kriminalistično operativno opravilo policije, katero ima procesno vrednost na sodišču, temveč gre za nadzorovan strokovni postopek, ki poteka v skladu s standardiziranimi metodami in načeli upravljanja kakovosti. Poudarek je na razumevanju ogleda kot strokovno nadzorovanega in standardiziranega postopka, v katerem se kakovost zagotavlja z uporabo enotnih metod dela, ustrezno usposobljenostjo izvajalcev, doslednim dokumentiranjem ter preprečevanjem kontaminacije in izgube dokazov, saj morebitne napake pri ogledu neposredno vplivajo na zanesljivost nadaljnjih forenzičnih analiz in končno dokazno vrednost ugotovitev v kazenskem postopku.

Title:Ensuring the quality of the forensic process in the slovenian police force
Abstract:In the diploma thesis, we presented forensic science and its fundamental quality principles on which the forensic process in the Slovenian police is based, with an emphasis on the role of the European Network of Forensic Science Institutes (ENFSI) and the National Forensic Laboratory (NFL) in ensuring the forensic process. The forensic process conducted at the crime scene represents a standardized sequence of steps, ranging from the arrival of the first police officer at the scene to the preparation of an expert report. ENFSI, which ensures the quality of development in the implementation of forensic sciences throughout Europe, ensures the establishment of effective measures for monitoring and quality assurance in the forensic process in several ways. It encourages the acquisition of accreditation by ENFSI members, the establishment of work practice, pre-qualification tests for experts, the establishment of a quality management system, the appropriate quality of equipment and materials, and the establishment of systems to prevent contamination. NFL, which is a Slovenian accredited testing laboratory according to the SIST EN ISO/IEC 17025 standard, ensures the reliability of its investigations with an implemented management system for the scope of laboratory activities, which includes 28 methods or procedures consistent with the aforementioned standard, namely impartial operation, standardized and traceable procedures, professionally trained experts, the use of modern maintenance equipment, the implementation of internal quality control of work, etc. NFL is also responsible for ensuring that police officers and forensic technicians are trained and equipped. For this purpose, they have prepared instructions for securing material traces that are in line with the aforementioned ENFSI. The diploma thesis shows that the quality management system does not only begin in the laboratory, but is included in the final revenue preparation phase and further in the crime scene investigation phase. Crime scene investigation is not merely a necessary, one-time, and unrepeatable criminal investigative activity carried out by the police, which has procedural value before the court; rather, it represents a controlled professional procedure conducted in accordance with standardized methods and quality management principles. The emphasis is placed on understanding crime scene investigation as a professionally supervised and standardized procedure, in which quality is ensured through the use of uniform working methods, appropriate competence of personnel, consistent documentation, and the prevention of contamination and loss of evidence. Potential errors during crime scene investigation directly affect the reliability of subsequent forensic analyses and the final evidentiary value of findings within criminal proceedings.
