Title:Izdelava standarda policijskega postopka : pregled osebe po 52. členu Zakona o nalogah in pooblastilih policije

Abstract:V diplomskem delu je obravnavan pregled osebe po 52. členu Zakona o nalogah in pooblastilih policije kot policijsko pooblastilo, namenjeno zasegu predmetov. Namen dela je analizirati zakonske pogoje za uporabo tega pooblastila, njegovo razmerje do varnostnega pregleda in osebne preiskave ter vpliv novejše sodne prakse na njegovo uporabo v policijski praksi. Posebna pozornost je namenjena neposredni zaznavi policista, standardu velike verjetnosti, osredotočenosti suma in privilegiju zoper samoobtožbo. Ugotovljeno je, da 52. člen ZNPPol formalno ostaja veljavno policijsko pooblastilo, vendar je njegova dokazna uporabnost po osredotočenosti suma bistveno omejena. Če oseba po pravnem pouku predmeta ne izroči prostovoljno, uporaba 52. člena ZNPPol kot prisilnega nadomestka za izročitev postane dokaznopravno tvegana. Delo posebej izpostavlja razliko med kaznivim dejanjem in prekrškom. Pri kaznivem dejanju lahko policija ob izpolnjenih pogojih uporabi ukrepe po ZKP, vključno s pridržanjem zaradi zavarovanja dokazov in pridobitve odredbe za osebno preiskavo. Pri prekršku pa primerljivo učinkovit mehanizem ni zagotovljen, zato nastane procesna praznina. Osrednji praktični rezultat diplomskega dela je drevo odločanja, ki policista vodi od namena ukrepa, neposredne zaznave in velike verjetnosti do presoje osredotočenosti suma, prostovoljne izročitve, razlikovanja med prekrškom in kaznivim dejanjem ter dokumentiranja postopka.

Title:Examination of a person under article 52 of the police tasks and powers act : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo
Abstract:The thesis examines the examination of a person under Article 52 of the Police Tasks and Powers Act as a police power intended for the seizure of objects. The purpose of the thesis is to analyse the statutory conditions for the use of this power, its relationship with a safety search and a personal search, and the impact of recent case law on its application in police practice. Special attention is given to direct police perception, the standard of high probability, focused suspicion and the privilege againstself-incrimination. The thesis finds that Article 52 remains a formally valid police power, but its evidentiary value after suspicion has become focused is significantly limited. If a person, after being informed of their rights, refuses to surrender an object voluntarily, the use of Article 52 as a coercive substitute for surrender becomes evidentially risky. The thesis also highlights the distinction between criminal offences and minor offences. In criminal cases, the police may, if statutory conditions are met, use measures under criminal procedure law, including detention for the purpose of securing evidence and obtaining a court order for a personal search. In minor offence cases, however, an equally effective mechanism is not available, which creates a procedural gap. The central practical contribution of the thesis is a decision tree that guides police officers from identifying the purpose of the measure, direct perception and high probability, to assessing focused suspicion, voluntary surrender, the distinction between minor and criminal offences, and proper documentation of the procedure.
