Title:Pomen forenzičnih sledi in dokazov v kazenskem pravosodju : magistrsko delo

Abstract:Forenzične sledi in dokazi predstavljajo pomemben vir informacij v kazenskem pravosodju, saj omogočajo povezovanje oseb, predmetov in dogodkov z obravnavanim protipravnim dejanjem. S pomočjo znanstveno podprtih forenzičnih preiskav sledi pridobijo dokazni pomen, vendar njihova vrednost ni samoumevna. Odvisna je od načina pridobivanja, interpretacije in umeščanja v širši dokazni kontekst. Forenzični dokazi tako ne predstavljajo zgolj tehničnih rezultatov laboratorijskih analiz, temveč strokovne ugotovitve, ki se v sodnem postopku presojajo v povezavi z drugimi dokazi ter v okviru procesnih pravil in načel kazenskega prava. V magistrskem delu je obravnavan pomen forenzičnih sledi in dokazov v slovenskem kazenskem pravosodju, s posebnim poudarkom na njihovem vrednotenju v sodniški praksi. Namen raziskave je bil preučiti, kakšna je percepcija sodnikov do različnih vrst forenzičnih dokazov, v kolikšni meri na njihovo presojo vpliva kontekst konkretnega primera ter kako vrsta forenzičnega dokaza vpliva na odločanje v sodnem postopku. Teoretični del izhaja iz razmejitve med forenzično sledjo in dokazom ter poudarja, da sled sama po sebi še ne predstavlja dokaza, temveč dokazno vrednost pridobi šele skozi proces strokovne interpretacije in pravne presoje. Empirični del pa zajema anketno raziskavo med sodniki kazenskih oddelkov slovenskih sodišč. Ugotovitve potrjujejo, da forenzični dokazi v sodni praksi predstavljajo pomemben, vendar ne samostojen temelj odločanja, saj se njihova dokazna vrednost oblikuje glede na okoliščine konkretnega primera. Zaključno delo poudarja tudi, da kakovostno forenzično dokazovanje samo po sebi ne zagotavlja pravične in učinkovite sodne odločitve, temveč mora biti umeščeno v celosten, kontekstualen in procesno ustrezen okvir kazenskega pravosodja.

Title:The Importance of Forensic Traces and Evidence in the Criminal Justice System
Abstract:Forensic traces and evidence constitute a significant source of information in criminal justice, as they enable the establishment of connections between persons, objects, and events in relation to the unlawful act under examination. Through scientifically grounded forensic investigations, traces acquire probative significance; however, their evidentiary value is not self-evident. It is contingent upon the way they are collected, interpreted, and contextualised within the broader evidentiary framework. Forensic evidence therefore does not represent merely the technical output of laboratory analyses, but rather expert findings that are assessed in judicial proceedings in conjunction with other evidence and within the procedural rules and principles governing criminal law. This master's thesis examines the significance of forensic traces and evidence in Slovenian criminal justice, with particular emphasis on their evaluation in judicial practice. The aim of the study was to investigate how judges perceive different types of forensic evidence, the extent to which the context of a specific case influences their assessment, and how the nature of forensic evidence affects decision-making in court proceedings. The theoretical framework proceeds from the distinction between a forensic trace and evidence, underscoring that a trace does not, in itself, constitute evidence; rather, it acquires probative value only through the process of expert interpretation and legal evaluation. The empirical part was conducted through a survey study among judges of the criminal divisions of Slovenian courts. The findings confirm that forensic evidence constitutes an important, yet not self-sufficient, basis for judicial decision-making in practice, given that its probative weight is shaped by the specific circumstances of each case. The thesis further underscores that high-quality forensic evidence does not, in and of itself, guarantee a fair and effective judicial outcome; rather, it must be embedded within a holistic, contextually sensitive, and procedurally appropriate framework of criminal justice.
