Title:Vpliv klimatskih sprememb na otrokove pravice : magistrsko delo

Abstract:Podnebne spremembe predstavljajo resno grožnjo uresničevanju človekovih pravic, zlasti pravic otrok, ki zaradi fizične, razvojne in socialne ranljivosti uživajo posebno varstvo po mednarodnem pravu. Zaradi onesnaževanja, okoljske degradacije in ekstremnih podnebnih pojavov, ki vplivajo na temeljne pravice otrok, je opazna vsa pogostejša udeležba otrok v boju proti kršitvam mednarodnih pravnih aktov, ki urejajo podnebne spremembe. Magistrsko delo se osredotoča na vpliv podnebnih sprememb na otrokove pravice, pri čemer se podrobneje analizirata vprašanji, kakšna je pravna ureditev podnebnih sprememb in kakšno pravno varstvo imajo otroci zaradi kršitve njihovih pravic. V skladu s tem so analizirani najpomembnejši mednarodni pravni viri, sodne prakse nacionalnih in mednarodnih sodišč, prelomni svetovalni mnenji o odgovornosti držav ter smernice Odbora Združenih narodov za otrokove pravice, ki naslavljajo problematiko podnebnih sprememb v povezavi s pravicami otrok. V magistrskem delu je ugotovljen jasen razvoj mednarodnega prava, ki nakazuje vse tesnejšo povezavo med varstvom otrokovih pravic in varstvom okolja. Pomembnejši dokument Odbora Združenih narodov za otrokove pravice, Splošni komentar št. 26, predstavlja pravne smernice, v katerem je priznana pravica otrok do čistega, zdravega in trajnostnega okolja, ki je implicitno zagotovljena v Konvenciji o otrokovih pravicah. Hkrati pa je Splošni komentar št. 26 določil obveznost držav, da zaščitijo otroke pred predvidljivo okoljsko škodo. Svetovalna mnenja mednarodnih sodišč prav tako jasno potrjujejo, da je varstvo podnebnega sistema nujen pogoj za uresničevanje temeljnih človekovih pravic, ter da je neukrepanje in pasivnost držav kršitev obveznosti po mednarodnem pravu. Analiza sodnih praks je pokazala, da pravno varstvo kršenih pravic otrok v kontekstu klimatskih sprememb ostaja omejeno, saj nekatera sodišča obravnavajo podnebne spore kot vprašanje politične presoje, kar vpliva na učinkovitost sodnega varstva. Kljub temu, pa je mogoče opaziti koncept povečane odgovornosti držav v povezavi s podnebnimi spremembami. Jasno je, da podnebne spremembe vplivajo na uživanje otrokovih pravic, vendar pa se vpliv podnebnih sprememb razteza tudi na pravni položaj prihodnjih generacij.

Title:The impact of climate change on the rights of the child
Abstract:Climate change poses a serious threat to the realisation of human rights, particularly the rights of children, who, due to physical, developmental, and social vulnerability, enjoy enhanced protection under international law. As a result of pollution, environmental degradation, and extreme climate events affecting children’s fundamental rights, there is a growing and increasingly visible participation of children in efforts to address violations of international legal documents regulating climate change. The master’s thesis focuses on the impact of climate change on children’s rights, with particular emphasis on the legal regulation of climate change and the legal protection available to children in cases of violations of their rights. Accordingly, the thesis analyses the most significant international legal instruments, the case law of national and international courts, landmark advisory opinions on state responsibility, and the guidelines of the United Nations Committee on the Rights of the Child addressing climate change in relation to children’s rights. The research identifies a clear development in international law, indicating an increasingly close connection between the protection of children’s rights and environmental protection. A key document of the United Nations Committee on the Rights of the Child, General Comment No. 26, provides legal guidance by recognising the child’s right to a clean, healthy, and sustainable environment, a right implicitly guaranteed by the Convention on the Rights of the Child. At the same time, General Comment No. 26 establishes the obligation of states to protect children from foreseeable environmental harm. Advisory opinions of international courts further clearly confirm that the protection of the climate system is a necessary precondition for the effective enjoyment of fundamental human rights, and that state inaction and passivity constitute a breach of obligations under international law. The analysis of case law demonstrates that legal protection of children’s rights in the context of climate change remains limited, as some courts continue to characterise climate-related disputes as matters of political discretion, thereby affecting the effectiveness of judicial protection. Nevertheless, an emerging concept of heightened state responsibility in relation to climate change can be observed. It is evident that climate change affects the enjoyment of children’s rights; however, its impact also extends to the legal position of future generations.
