Title:OSINT kot orodje preiskovanja kaznivih dejanj, povezanih s kriptovalutami : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu je obravnavana odprtokodna obveščevalna dejavnost (OSINT) kot orodje preiskovanja kaznivih dejanj, povezanih s kriptovalutami, v slovenskem in širšem evropskem prostoru. V teoretičnem delu so opredeljeni pojem, razvoj in ključne značilnosti OSINT, predstavljeni pa so tudi glavni viri, orodja in tehnike za analizo kriptovalut in blockchain omrežij ter razmerje med OSINT in klasičnim finančnim preiskovanjem. Poseben poudarek je namenjen tipičnim oblikam kripto kaznivih dejanj, pri katerih je OSINT posebej uporaben, ter načinom, kako OSINT prispeva k atribuciji kripto denarnic, prepoznavanju subjektov in analizi transakcijskih tokov. V nadaljevanju je analiziran pravni in etični okvir uporabe OSINT pri preiskovanju kripto kaznivih dejanj, s poudarkom na Splošni uredbi o varstvu podatkov (GDPR), Zakonu o varstvu osebnih podatkov (ZVOP‑2) in Zakonu o varstvu osebnih podatkov na področju obravnavanja kaznivih dejanj (ZVOPOKD). Diplomsko delo je zasnovano kot teoretična raziskava, ki temelji na kvalitativni analizi domače in tuje literature ter javno dostopnih dokumentov policije in mednarodnih organizacij. Ugotovljeno je, da OSINT predstavlja pomembno dopolnilo klasičnim preiskovalnim metodam in analizi blockchaina, pri čemer so kot ključni izzivi prepoznani zagotavljanje skladnosti z varstvom osebnih podatkov, tveganje napačne atribucije ter potreba po sistematičnem usposabljanju in standardizaciji postopkov v organih pregona.

Title:Osint as a tool for investigating cryptocurrency-related crime
Abstract:In this thesis, open‑source intelligence (OSINT) is examined as a tool for investigating cryptocurrency‑related crime in the Slovenian and broader European context. The theoretical part defines the concept, development and key characteristics of OSINT and presents the main sources, tools and techniques for the analysis of cryptocurrencies and blockchain networks, as well as the relationship between OSINT and traditional financial investigation. Particular attention is devoted to typical forms of cryptocurrency‑related crime in which OSINT is especially useful and to the ways in which OSINT contributes to the attribution of crypto wallets, the identification of subjects and the analysis of transaction flows. The thesis then analyses the legal and ethical framework for the use of OSINT in the investigation of cryptocurrency‑related crime, with a focus on the General Data Protection Regulation (GDPR), the Personal Data Protection Act (ZVOP‑2) and the Act on the Protection of Personal Data in the Field of Criminal Offences (ZVOPOKD). The thesis is designed as a theoretical study based on a qualitative analysis of domestic and foreign literature and publicly available documents of the police and international organisations. It finds that OSINT represents an important complement to traditional investigative methods and blockchain analysis, while key challenges include ensuring compliance with personal data protection rules, mitigating the risk of misattribution and strengthening systematic training and standardisation of procedures within law‑enforcement agencies.
