Title:Uporabnost forenzične psihološke ocene pri psihičnem nasilju : magistrsko delo

Abstract:V tem magistrskem delu sta bili obravnavani vloga in uporabnost forenzične psihološke ocene pri dokazovanju psihičnega nasilja, ki v sodobnem pravosodju predstavlja velik izziv zaradi svoje prikritosti in pomanjkanja materialnih dokazov. Namen dela je bil analizirati, v kolikšni meri je s sodobno forenzično psihologijo ob uporabi znanstveno utemeljenih metod mogoče dokazati psihično škodo in s tem podpreti pravne postopke v okviru slovenske zakonodaje. Skozi pregled literature je bilo ugotovljeno, da dolgotrajna izpostavljenost psihičnemu nasilju pušča merljive posledice, kot so razdrobljenost spomina, mentalni upad in strukturne spremembe v možganih. Proces forenzičnega ocenjevanja mora temeljiti na metodološki primerjavi virov in uporabi standardiziranih psihometričnih orodij, kot sta MMPI-2 in PAI. Poseben poudarek je namenjen ugotavljanju verodostojnosti izjav s pomočjo metod SVA in CBCA ter teorije ADCAT, ki omogočajo razlikovanje med dejansko doživeto travmo in namernim hlinjenjem simptomov. Izpostavljen je problem napačne diferencialne diagnoze, pri kateri se simptomi kompleksne posttravmatske stresne motnje (K-PTSM) pogosto zmotno interpretirajo kot osebnostne motnje ali neverodostojnost, kar vodi v sekundarno viktimizacijo žrtve. V zaključku so podani predlogi za standardizacijo protokolov, večjo integracijo nevropsiholoških dokazov v izvedenska mnenja in nujno implementacijo evropskih standardov (»Direktiva (EU) 2024/1385 o boju proti nasilju nad ženskami in nasilju v družini«, 2024). Raziskavo dopolnjuje intervju s strokovnjakinjo, ki podrobneje osvetljuje praktične vidike obravnave psihičnega nasilja v Sloveniji in usmerja razvoj bodočih strokovnih standardov.

Title:Usefulness of forensic psychological assessment in psychological violence
Abstract:In this master's thesis, the role and applicability of forensic psychological assessment in proving psychological violence were addressed. In modern justice, this topic represents a major challenge due to its covert nature and the lack of material evidence. The purpose of the work was to analyze the extent to which it is possible to prove psychological damage through modern forensic psychology, using scientifically based methods, and thereby support legal proceedings within the framework of Slovenian legislation. Through a literature review, it was established that long-term exposure to psychological violence leaves measurable consequences, such as memory fragmentation, mental decline, and structural changes in the brain. The process of forensic assessment must be based on a methodological comparison of sources and the use of standardized psychometric tools, such as the MMPI-2 and PAI. Special emphasis is placed on determining the credibility of statements using SVA and CBCA methods, as well as the ADCAT theory, which all enable a differentiation between actually experienced trauma and the intentional feigning of symptoms. The problem of misdiagnosis in differential diagnostics is highlighted, where the symptoms of complex post-traumatic stress disorder (C-PTSD) are often mistakenly interpreted as personality disorders or lack of credibility, leading to the secondary victimization of the victim. In conclusion, proposals are presented for the standardization of protocols, greater integration of neuropsychological evidence into expert opinions, and the urgent implementation of European standards ("Directive (EU) 2024/1385 on combating violence against women and domestic violence", 2024). The research is complemented by an interview with an expert, which sheds more light on the practical aspects of dealing with psychological violence in Slovenia and guides the development of future professional standards.
