Title:Sistem sankcioniranja prekrškov s področja prepovedanih drog v Republiki Sloveniji : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu je bil analiziran sistem sankcioniranja prekrškov s področja prepovedanih drog v Republiki Sloveniji z vidika doseganja ciljev, ki jih je zakonodajalec zastavil ob sprejemu Zakona o proizvodnji in prometu s prepovedanimi drogami. Raziskava je bila zasnovana kot kvalitativna pravna analiza z uporabo deskriptivne metode, normativne analize, primerjalne metode ter razlagalnih metod prava po Pavčniku. Ugotovljeno je bilo, da je zakonodajalec ob sprejemu zakona zastavil pretežno administrativno-nadzorni okvir urejanja področja prepovedanih drog. Na podlagi analize veljavne zakonodaje in sodne prakse treh primerov slovenskih sodišč je bilo ugotovljeno, da sistem sankcioniranje cilje zakonodajalca dosega le delno. Administrativni in nadzorni cilji so v pretežni meri doseženi, medtem ko cilj preprečevanja nedovoljenega prometa in zlorabe prepovedanih drog ostaja dosežen le delno. Kot ključna strukturna pomanjkljivost je bila identificirana nedoločenost pojma "manjša količina za enkratno lastno uporabo" v drugem odstavku 33. člena zakona, kar v praksi vodi do nedoslednih odločitev v podobnih primerih. Predlagano je bilo, da zakonodajalec z novelo zakona natančneje opredeli te pojme, bodisi z določitvijo orientacijskih količinskih mej bodisi z uvedbo obvezne sodne razlage.

Title:The system of sanctioning drug-related misdemeanors in Slovenia
Abstract:The thesis analyses the system of sanctioning drug-related misdemeanors in the Republic of Slovenia from the perspective of achieving the objectives set by the legislator upon the adoption of the Act on the Production and Trade in Illicit Drugs. The research was designed as a qualitative legal analysis using descriptive, normative, comparative and interpretive legal methods as defined by Pavčnik. It was established that the legislator set primarily an administrative and supervisory framework for regulating the field of illicit drugs. Based on the analysis of applicable legislation and the case law of three Slovenian court decisions, it was found that the sanctioning system only partially achieves the legislator's objectives. The administrative and supervisory objectives are largely met, while the objective of preventing illicit trafficking and abuse of drugs remains only partially achieved. The key structural deficiency identified was the indeterminate nature of the concept of "a smaller quantity for single personal use" in the second paragraph of Article 33 of the Act, which in practice leads to inconsistent decisions in similar cases. It was proposed that the legislator should more precisely define these concepts through an amendment to the Act, either by establishing indicative quantity thresholds or by introducing mandatory judicial interpretation.
