Title:Dostopnost do strelnega orožja v državah Evropske unije : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomski nalogi je bila izvedena primerjalna analiza dostopnosti do strelnega orožja v štirih državah Evropske unije – Sloveniji, Nemčiji, Češki in Avstriji. Namen analize je bil ugotoviti, kako nacionalna zakonodaja vpliva na pogoje za pridobitev, posedovanje in nošenje orožja ter kakšne so razlike med strožjimi in manj strožjimi zakonskimi ureditvami. Analiza je temeljila na pregledu pravnih virov, strokovne literature in statističnih podatkov. Ugotovljeno je bilo, da v nacionalnih zakonodajah izbranih držav kljub skupnim evropskim okvirom obstajajo številne razlike v pristopih. Za Nemčijo je značilna strožja regulacija z zahtevnimi preverjanji, omejitvami ter obveznim zavarovanjem odgovornosti. Avstrija in Slovenija imata zmerno strogo ureditev sistema, pri čemer Avstrija izstopa s sistemom dveh vrst orožnih dovoljenj, Slovenija pa s kompleksnejšim sistemom devetih vrst orožnih dovoljenj, ki so natančno določene in opredeljene. Češka temelji na liberalnejši ureditvi posedovanja orožja s poudarkom na individualni odgovornosti. Ugotovitve kažejo, da stopnja civilnega posedovanja orožja ni neposredno sorazmerna s strogostjo zakonodaje, saj Avstrija beleži najvišjo stopnjo posedovanja orožja, medtem ko ima Češka kljub liberalnejši ureditvi precej nižjo stopnjo. Rezultati potrjujejo, da zakonodaja vpliva na dostopnost do orožja, vendar nanjo vplivajo tudi kulturne, zgodovinske in družbene okoliščine. Kljub razlikam v zakonodaji vse analizirane države beležijo nizko stopnjo nasilja z orožjem, kar kaže na učinkovitost njihovih zakonodajnih modelov.

Title:Access to firearms in european union countries
Abstract:In the thesis, a comparative analysis of access to firearms was conducted in four European Union countries – Slovenia, Germany, the Czech Republic, and Austria. The purpose of the analysis was to determine how national legislation affects the conditions for acquiring, possessing, and carrying firearms, and to identify the differences between more and less strict regulatory frameworks. The analysis was based on a review of legal sources, scholarly literature, and statistical data. It was found that, despite common European frameworks, the national legislations of the selected countries exhibit numerous differences in their approaches. Germany is characterized by stricter regulation, involving demanding background checks, restrictions, and liability insurance requirements. Austria and Slovenia have moderately strict systems, with Austria standing out due to its system of two types of firearms permits, while Slovenia features a more complex system of nine precisely defined and regulated types of firearms permits. The Czech Republic, on the other hand, relies on a more liberal regulation of firearm possession, emphasizing individual responsibility. The findings indicate that the level of civilian firearm ownership is not directly proportional to the strictness of the legislation, as Austria records the highest rate, while the Czech Republic, despite its more liberal framework, has a significantly lower rate of civilian firearm ownership. The results confirm that legislation does influence access to firearms; however, cultural, historical, and social circumstances also play a significant role. Despite their differences, all the countries examined record a low level of firearm-related violence, which demonstrates the effectiveness of the legislative models in the selected countries.
