Abstract:Diplomska naloga »Prilagoditev tržnih dejavnosti državnih monopolov pravilom notranjega trga EU« predstavlja analizo usklajenosti ekskluzivnih nabavnih in prodajnih pravic državnih monopolov tržne narave s pravili notranjega trga Evropske unije. Pravo Evropske unije v okviru splošne gospodarske pobude in razvoja tržne dejavnosti prepoveduje javno-pravnim subjektom tržnega značaja postavljanje nedovoljenih mej in zapiranje določenih delov notranjega trga. Da bi ti subjekti delovali skladno s pravili notranjega trga Evropske unije, mora biti njihovo delovanje prilagojeno na način, ki izključuje vsakršno diskriminacijo med državami članicami in omogoča potrošnikom v državi monopola dostop do proizvodov v pogojih poštene tržne konkurence. Sodišče Evropske unije je skozi sodno prakso dokazalo, da je delovanje zadevnih monopolov oblikovalo dve obliki prepovedane diskriminacije: diskriminacijo proizvodov, ki ne zahteva odprave s strani države dodeljenih ekskluzivnih pravic državnemu monopolu, zadostuje le identična obravnava domačih in tujih proizvodov, ter diskriminacijo tržnih subjektov držav članic, ki pa zahteva odpravo dodeljene izključne pravice, ker pravni akt, ki to pravico pridržuje domačim subjektom, s tem neposredno škoduje subjektom iz drugih držav članic glede izvajanja njihove gospodarske dejavnosti. V novejši sodni praksi, predvsem zadevi Rosengren, Sodišče Evropske unije krči možnost držav članic, da uporabljajo državne monopole za zasledovanje ciljev javnih interesov. Določeno ekskluzivno pravico pa lahko kljub temu, na podlagi pogojev iz člena 106 Pogodbe o delovanju Evropske unije, tudi opravičimo in opredelimo za skladno z notranjim trgom Evropske unije. Diplomska naloga pa v zadnjem delu izpostavlja vključitev rešitev iz zadeve Hanner v slovenski nacionalni prostor in s tem prilagoditev slovenskega monopola nad prodajo cepiv pravilom notranjega trga Evropske unije.

Title:“Adjustment of state monopolies’ commercial activities to the EU internal market regulations”
Abstract:The thesis entitled “Adjustment of state monopolies’ commercial activities to the EU internal market regulations” presents an analysis of the conformity of state monopolies of commercial characters’ exclusive purchase and distribution rights with the EU internal market regulations. Namely, the EU law in the context of economic initiative and market activities does not allow public legal bodies of a commercial character to set prohibited borders and isolate certain parts of the internal market. In order for these bodies to operate in accordance with the EU internal market regulations, their activities have to be adapted in a manner that excludes any discrimination among Member States and enables the consumer in the state where the monopoly is taking place access to goods under conditions of fair market competition. With its case-law the Court of Justice of the European Union proved that the activities of these monopolies formed two types of prohibited discrimination. The first one is the discrimination of goods that does not demand a suppression of exclusive rights, awarded to the state monopoly by the state; all that is necessary is an identical treatment of both home-made and imported goods. The second type is the discrimination against the market bodies of the Member States that demands a suppression of exclusive rights on the basis of a legal act that provides such right to domestic bodies and by that impairs the bodies from other Member States regarding their economic performance. In the newer case-law, especially in the Rosengren case, the Court of Justice of the European Union reduces the opportunity of Member States to use state monopolies for pursuing goals of public interests. However, on the basis of Article 106 of the Treaty on the Functioning of the EU a certain exclusive right may nevertheless be justified and classified as consistent with the EU internal market. The last part of the thesis highlights the inclusion of the Hanner case findings into the Slovenian national spot and by that adapting the Slovenian monopoly of sales of vaccine to the EU internal market regulations.
