Title:TEMELJNA NORMA - PREDPOSTAVKA ZA SNOVANJE USTAVE?

Abstract:Hans Kelsen veljavnost postavljenega pravnega reda ter vprašanje, ali določena pravna norma zavezuje naslovljence navezuje na vprašanje temeljne norme. Gre za predpostavljeno abstraktno strukturo, ki mora zaradi fundamentalne razlike med načinom povezanosti pravnih norm ter dejanskih dogodkov izhajati iz sfere Sollen. Vendar pa Kelsen te dvojnosti ne upošteva dosledno, kar je razvidno iz vzporedne vezanosti veljavnosti pravnega reda na učinkovitost, ki je očitno zasidrana v sferi Sein. Potreba po pravni normi tako postane vprašljiva. Takšno navezovanje je vprašljivo tudi iz vidika ohranjanja čistosti pravne znanosti, cilja, ki si ga zada na začetku Čiste teorije prava. Nadalje je postavitev temeljne norme kot najvišjega in temeljnega člena stopnjevitega pravnega reda vprašljiva tudi zaradi argumenta neskončnega regresa ter nejasnosti glede tako temeljnega vprašanja, kot je to, kdo temeljno normo sploh lahko predpostavlja. Zaradi teh razlogov menimo, da temeljna norma, kot je predstavljena v Čisto teoriji prava, ne predstavlja trdnega in logično argumentiranega temelja za snovanje ustave ali razloga za veljavnost pravnega reda.

Title:BASIC NORM - A CONSTITUTIONAL PREDISPOSITION?
Abstract:Hans Kelsen contended the validity of a positive legal order and the ability of legal norms to bind legal subjects with a notion of a basic norm. Basic norm is a predisposition, an abstract structure that derives from Sollen. This is due to the fundamental differences between normative connections and causal connections between actual events. Kelsen, however, doesn't go through with this duality. He establishes a peculiar system in which the legal system is also determined by effectiveness, which obviously derives from Sein. The need of having to base the legal system in a basic norm becomes questionable, as does the argument of purity of legal science, a cornerstone of Kelsen's Pure Theory of Law. The grounding of a hierarchical legal system in a basic norm is furthermore questionable because of the argument of infinite regress. Kelsen was also not able to provide a definite answer to the following basic question: who can presuppose the basic norm? All this reasons have lead us to a conclusion that the basic norm, as described in the Pure Theory of Law, is not a convincing and well-rounded Grund for validity of a legal system; it should not be viewed upon as a constitutional predisposition.
