Abstract:“In a chapter of human rights and fundamental freedoms of the Republic Slovenia is written, that everybody has the right to personal freedom and nobody should be taken away their custody, except in cases and process that is determined by the law.” (Žaberl, 2006: 125) Because of the rough intervention in the personal freedom of individual, it is necessary to know the law regulations for this specified area very well. In this case policeman and criminal investigator, that are dealing with this assignment of discovering and researching criminal acts from forbidden drug area, often come in dilemma, when the terms are fulfilled with “justified reasons for suspect” of criminal act. The dilemma is, does simply seized substance satisfies law standard of “justified reasons for suspect” for criminal act, despite testing for forbidden drugs has not been made, or “justified reasons for suspect” appear after the positive testing for forbidden drugs. Of course it is necessary to highlight that the possession of forbidden drugs does not satisfy the law standard of “justified reasons for suspect”. It is necessary to consider other circumstances like amount, the way of packing, possession and accessories that are used for drug dealing (electronic scales, small PVC bags, aluminum foils packages, and so on), the buyer of illegal drug identification... In particular police treatment policeman or crime detective limits personal movement for the necessary period of time before the result of analysis. In the case of positive result, that the seized substance is illegal drug, condition is given to deprivation of liberty and police custody. There seems to be no difference between police custody and deprivation of liberty. This reflects in intensity of intervention in human rights and fundamental freedom and also intended use of police powers.
