Abstract:	Pri načrtovanju izgradnje javne infrastrukture se država in lokalne skupnosti nemalokrat srečajo s problematiko umestitve v prostor. Pri tem je potrebno pretehtati, katera trasa bo najcenejša in preveriti, po katerih nepremičninah bo trasa infrastrukture potekala. V konkretnih primerih se velikokrat srečajo z nepremičninami v zasebni lasti. Diplomska naloga bo predstavila postopke, ki jih imajo organi javnega prava na voljo, da pridobijo ustrezno pravico graditi na tem nepremičnem premoženju. Najbolj enostaven način je nedvomno pravno-poslovna pridobitev, pri kateri se stranki sporazumeta o vseh bistvenih sestavinah in podpišeta pogodbo o prodaji nepremičnine oziroma drugi razpolagalni pravici. V primeru, da stranki ne dosežeta sporazuma, pa imajo javni organi na voljo različne instrumente, s katerimi »prisilijo« lastnike k prodaji o oziroma omejitvi lastninske pravice. Ti instrumenti, ki so v diplomski nalogi podrobneje opisani in predstavljeni so razlastitev, ustanovitev stvarne služnosti oziroma stavbne pravice in začasna pravica uporabe nepremičnine.

Title:	GOVERNMENT'S AND LOCAL GOVERNMENT'S METHODS TO ACQUIRE REAL ESTATE FOR CONSTRUCTING PUBLIC UTILITIES NETWORKS
Abstract:	When planning the construction of community facilities, state and local governments are often faced with the challenge of location. The cost of construction, as well as the cost of property the infrastructure is going to cross, needs to be taken into consideration when deciding the location. In the majority of cases the properties are privately owned. This bachelor's thesis will present the methods available to governmental institutions in gaining building rights on such properties. The most straightforward method is the acquisition of the property from its owner, where the interested parties stipulate a contract transferring property rights. If the property owner disputes the government's offer to buy, the government has several methods to secure land ownership and/or building rights. These methods are expropriation, easement, building right and temporary use of land.
