Abstract:Delavčeva obveznost obveščanja izhaja iz 36. člena Zakona o delovnih razmerjih in je vsebinsko razdeljena na dva dela. Na eni strani mora delavec delodajalca obveščati o vseh bistvenih okoliščinah, ki vplivajo oziroma bi lahko vplivale na izpolnjevanje njegovih pogodbenih obveznosti in pravic iz delovnega razmerja, na drugi strani pa ga mora obveščati tudi o vsaki grozeči nevarnosti, ki jo zazna pri delu. Predvsem pri obveščanju o okoliščinah, ki (lahko) vplivajo na izpolnjevanje obveznosti in pravic iz delovnega razmerja je težko zarisati mejo med podatki, glede katerih mora delavec delodajalca obveščati in podatki, ki predstavljajo delavčevo zasebno življenje. V diplomskem delu je delavčeva obveznost obveščanja podrobneje predstavljena na posameznih primerih, zakonska in teoretična podlaga je podkrepljena z relevantnimi primeri sodne prakse, avtorica pa predstavi tudi sankcije ki sledijo, v kolikor delavec svoje obveznosti ne izpolnjuje.

Title:The employee's notification duty
Abstract:The employee's notification duty is derived from the 36. article of Zakon o delovnih razmerjih and the content is divided into two parts. On one hand, the employee must inform the employer of all relevant circumstances which affect or might affect the fulfillment of its contractual obligations and rights arising from the employment relationship, on the other hand, he also must notify the employer of any impending danger he notices at work. Particularly in informing of circumstances, that (may) affect the obligations and rights arising from the employment relationship it is difficult to draw the line between the data on which the employee must inform the employer and the data representing the worker's private life. The thesis the employee's obligation to inform is presented in detail on individual cases, the legal and theoretical base is supported by the relevant case law, the author also presents sanctions that follow, if the employee’s professional obligations are not met.
