Title:Nevropravice v pravu človekovih pravic : magistrsko delo

Abstract:Magistrsko delo obravnava problematiko varstva človekovih pravic pred vplivi nevrotehnologije in nevrotehnoloških naprav ter v ospredje postavlja idejo o nevropravicah kot okviru (novih) človekovih pravic. Avtorica sprva obravnava možnosti, ki jih nevrotehnologija šele prinaša in možnosti, ki jih je nevrotehnologija že prinesla in s tem različne možne posege v možgane ter možgansko aktivnost posameznika. Slednje avtorica kritično ovrednoti in izpostavi točke, kjer se je družba že »opekla«, ko je moč nevrotehnologije spustila predaleč in s tem povzročila razmah novih etičnih in pravnih vprašanj. Skozi dodatno pojasnilo o trenutni razvitosti nevrotehnologije magistrsko delo izpostavi tako koristi kakor tudi etične dileme nevrotehnoloških odkritij ter pojasni problematiko, ki jo za pravo človekovih pravic predstavljata vzpon digitalizacije in nevrotehnologij. Pri tem avtorica izpostavi probleme s katerimi se (bo) človeštvo spopada(lo), jih kritično analizira in postavlja zametke temeljne družbene odgovornosti, z uvedbo katerih bi lahko razvoj omejili in ohranili le na mestih, kjer nam kot družbi zares koristi. Magistrsko delo predstavi idejo o nevropravicah kot okviru človekovih pravic, ki je namanjen zaščiti posameznikovih interesov v zvezi z naraščajočim vzponom nevrotehnologij. Avtorica skozi analizo mnenj pravnikov in teoretikov podrobneje opiše različne predloge nevropravic, pri čemer se avtorica opredeli tudi do ideje, da bi morda bila uvedba ene nove nevropravice, tj. pravice do kognitivne svobode oziroma duševne samoodločbe, dovolj. Prav tako pa se v magistrskem delu avtorica opredeli tudi do drugih v teoriji predlaganih rešitev v boju proti vplivi nevrotehnologij, ki bi lahko predstavljale potencialno zaščito. Pri tem avtorica osvetli rešitev, ki ideji nevropravicah stoji ostro nasproti in sicer avtorica predstavi možnosti širjenja obsega varstva in interpretacije obstoječih človekovih pravic tudi na posledice, ki jih prinaša uporaba invazivnih in neinvazivnih naprav nevrotehnologije. Magistrsko delo se skozi obravnavo dojemanja in razlage avtorjev iz različnih pravnih in nepravnih področji (primeroma, fiziologov, psihologov in medicincev) opredeli do možnosti širše intepretacije obstoječih pravic, pri čemer v ospredje postavi idejo o nevropravicah kot edini dovoljšni možnosti za zaščito pred vplivi nevrotehnologij.

Title:Neuro-rights in human rights law
Abstract:The master's thesis addresses the issue of protecting human rights from the influences of neurotechnology and neurotechnological devices, highlighting the concept of neuro-rights as a framework for (new) human rights. The author first explores the possibilities that neurotechnology brings and the interventions in brain and individual brain activity that it has already enabled. The thesis critically evaluates these developments and highlights instances where society has faced ethical and legal challenges due to the far-reaching impact of neurotechnology. Through further explanation of the current state of neurotechnology, the thesis discusses both the benefits and ethical dilemmas posed by neurotechnological advancements. It explains the issues presented for human rights by the rise of digitization and neurotechnologies. The author identifies the problems humanity currently is or will be facing, critically analyzes them, and lays the groundwork for fundamental social responsibility. This responsibility, if implemented, could limit development to areas where it truly benefits society. The thesis introduces the concept of neuro-rights as part of human rights, aimed at safeguarding individual interests amidst the increasing prominence of neurotechnologies. By analyzing opinions from legal experts and theorists, the author elaborates on various proposals for neuro-rights. The thesis also explores the idea that introducing only one new neuro-right, namely the right to cognitive freedom or mental self-determination, might be sufficient. Additionally, the thesis examines other potential protections against the influences of neurotechnologies. The author sheds light on an idea that stands in stark contrast to the concept of neuro-rights: expanding the scope of protection and interpretation of existing human rights to cover the consequences of using invasive and non-invasive neurotechnological devices. By considering perspectives from various legal and non-legal fields, such as physiologists and medical professionals, the thesis delves into the possibility of broader interpretations of existing rights, emphasizing the concept of neuro-rights as the only adequate means of protection against the influences of neurotechnologies.
