Title:Vpliv kriminalističnega profiliranja pri aretaciji storilcev kaznivih dejanj : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:V okviru diplomskega dela je bila obravnavana uporaba kriminalističnega profiliranja kot dopolnilne metode pri preiskovanju kaznivih dejanj. Analizirano je bilo, kako to orodje prispeva k identifikaciji in aretaciji storilcev, pri čemer je bila pozornost usmerjena predvsem na njegovo učinkovitost, omejitve ter vpliv subjektivnih dejavnikov, kot so stereotipi, predsodki in kulturne pristranskosti. Preučeni so bili trije osrednji pristopi: kriminalistično preiskovalna analiza, preiskovalna psihologija in geografsko profiliranje, ki so bili primerjani glede na njihovo metodo, cilje, uporabnost in omejitve. Ugotovljeno je bilo, da se kriminalistično profiliranje kot samostojna metoda redko izkaže za dovolj zanesljivo, vendar le v kombinaciji z drugimi preiskovalnimi tehnikami, kot so forenzična analiza, pričanje ali analiza DNA, pomembno prispeva k zmanjšanju kroga osumljencev. Pri pregledu zgodovinskih primerov, kot so procesi v obdobju srednjeveških inkvizicij oziroma t.i. lov na čarovnice, je bilo ugotovljeno, da lahko uporaba metod, ki spominjajo na profiliranje, ob odsotnosti strokovnih standardov in etične regulacije vodi v sistematične kršitve človekovih pravic in krivične obsodbe. Izpostavljeno je bilo, da neobjektivna in nekritična uporaba profiliranja lahko privede do neupravičenega sumničenja nedolžnih oseb, kar zahteva strogo strokovno presojo in regulacijo v sodobni praksi. Potrjeni sta bili obe raziskovalni hipotezi, pri čemer je bilo poudarjeno, da se učinkovita uporaba kriminalističnega profiliranja doseže le z interdisciplinarnim pristopom in jasno opredeljenimi etičnimi okvirji. Na tej osnovi je bila predlagana potreba po nadaljnjem raziskovanju metodoloških pristopov in po oblikovanju izobraževalnih programov za profilerje. S tem bi se zagotovila večja objektivnost in zmanjšalo tveganje za napačne preiskovalne sklepe.

Title:The role of criminal profiling in arresting felony offenders
Abstract:This thesis examined the use of criminal profiling as a complementary method in the investigation of criminal offences. The focus was placed on how this tool contributes to the identification and apprehension of offenders, with particular attention given to its effectiveness, limitations, and the influence of subjective factors such as stereotypes, biases, and cultural prejudices. Three central approaches - criminal investigative analysis, investigative psychology and geographical profiling – were analysed and compared in terms of their methodology, objectives, practical applicability, and limitations. It was found that criminal profiling, when used independently, is rarely sufficiently reliable; however, when combined with other investigative techniques such as forensic analysis, witness testimonies, or DNA evidence, it significantly contributes to narrowing the pool of suspects. Historical cases, includingg those from the period of the medieval inquisitions and the so- called »witch hunts«, demonstrated that the use of methods resembling profiling- without professional standards or ethical oversight- can result in systematic violations of human rights and wrongful convictions. It was emphasized that uncritical and subjective application of profiling increases the risk of unjust suspicion toward innocent individuals, underscoring the need for rigorous professional judgement and regulatory framework in contemporary practice. Both research hypotheses were confirmed, highlighting that the effective use of criminal profiling requires an interdisciplinary approach and clearly defined ethical boundaries. On this basis, the need for further research into methodological practices and the development of educational programs for profilers was proposed, in order to enhance objectivity and reduce the risk of erroneous investigative conclusions.
