Title:Videoconference as an instrument of oral hearing in court proceedings and its interference with the principle of immediacy
Abstract:In civil and criminal proceedings, applications to the court can be filed in electronic form, parties and other participants can participate in hearings using videoconferencing, and courts can serve their decisions electronically. The purpose of conducting procedures in this manner is to ensure their speed and efficiency. Appropriate legal basis has been available to the courts for some time and measures to prevent the spread of the viral disease COVID-19 have accelerated progress in this area, especially with the possibility of using videoconferencing, which enables the court to conduct main hearings and question parties, witnesses and experts without the need for them to be physically present in the courtrooms. Therefore, due to the psychological aspect of conducting evidence using a videoconference and the influence of the non-verbal impression of the interrogated person on the judge's perception, special attention should be paid to the respect of the fundamental principles, especially the principle of immediacy. Answers to the questions that arise in relation to the use of videoconferencing in court procedures, must be sought with an interdisciplinary and comparative law approach.
