Title:Prezasedenost zaporov v Sloveniji : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Zaključno delo se osredotoča na (pre)zasedenost slovenskih zaporov. V prvem delu so predstavljena različna pojmovanja kapacitet zaporov in njihove zasedenosti ter dejavniki, ki vplivajo na prezasedenost zaporov. V drugem delu zaključnega dela se osredotočamo na stanje v slovenskem zaporskem sistemu. Opisan je razvoj slovenskega zaporskega sistema z vidika povečevanja prostorskih kapacitet v obdobju 2000–2024. Hkrati smo analizirali statistične podatke o zasedenosti slovenskih zaporov v istem obdobju. Posamezni slovenski zapori so prezasedeni že dvajset let, v zadnjih treh letih pa je prezasedenost izrazito narasla in je prisotna v skoraj vseh slovenskih zaporih. Razlogi za prezasedenost so številni in kompleksni, se medsebojno navezujejo, hkrati pa tudi ločeno spreminjajo v različnih časovnih obdobjih. Kljub temu pa je mogoče strniti, da je glavni dejavnik za prezasedenost predvsem zaostrovanje kaznovalne politike države, čezmerna uporaba in trajanje pripora ter omejena uporaba možnih zakonodajnih alternativ priporu in zaporni kazni, povratništvo, dolgotrajni kazenski postopki ter ne nazadnje tudi pomanjkanje prostorskih kapacitet. V zaključku so predstavljene možne rešitve, ki bi dolgoročno lahko pripomogle k reševanju prostorske problematike v slovenskem zaporskem sistemu.

Title:Overcrowding of prisons in Slovenia
Abstract:The final thesis focuses on (over)crowding of Slovenian prisons. In the first part, various concepts of prison capacities and their occupancy, as well as factors influencing prison overcrowding, are presented. In the second part of the thesis, we focus on the situation in the Slovenian prison system. The development of the Slovenian prison system is described from the perspective of increasing spatial capacities in the period 2000–2024. At the same time, we analysed statistical data on the occupancy of Slovenian prisons in the same period. Overcrowding has been present in individual Slovenian prisons for almost twenty years, and in the last three years, overcrowding has significantly increased and spread to almost all Slovenian prisons. The reasons for overcrowding are numerous and complex, interconnected, and vary in different time periods. Nevertheless, it can be summarised that the main reasons for overcrowding are primarily the tightening of the penal policy, excessive use and duration of detention, limited use of possible legislative alternatives to detention and imprisonment, recidivism, lengthy criminal proceedings, and finally, the lack of spatial capacities. In conclusion, possible solutions that could, in the long term, contribute to solving the spatial problems in the Slovenian prison system are presented.
