Title:Primerjalna analiza smrtne kazni med državami po svetu : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:V zaključnem delu je bila izvedena primerjalna analiza smrtne kazni v petih državah z raznolikimi pravnimi tradicijami in političnimi sistemi. Preučeni so bili zgodovinski razvoj instituta smrtne kazni, temeljni teoretični pristopi ter mednarodnopravni okvir, ki ureja omejitve in postopno odpravo te sankcije. Analiza je bila usmerjena v pregled kazenskopravnih ureditev, postopkovnih jamstev, katalogov kaznivih dejanj, metod izvrševanja ter statističnih podatkov o izrekanju in izvrševanju smrtne kazni v Združenih državah Amerike, Rusiji, Iranu, Savdski Arabiji in Indiji. Ugotovljeno je bilo, da odprava ali ohranitev smrtne kazni ni odvisna zgolj od zakonodaje, temveč od širšega političnega in institucionalnega okvira. Pomembno vlogo pri obstoju te oblike kazni v določeni državi ima njena vladavina prava, verske norme, moč civilne družbe in javno mnenje. Primerjalni pregled je pokazal tri prevladujoče tipe držav: visokofrekvenčni retentionizem (Iran in Savdska Arabija), nizkofrekvenčni retentionizem (ZDA in Indija) ter de facto abolicijo ob formalni zakonski dopustnosti (Rusija). Analiza je potrdila, da so procesna jamstva, stopnja demokratičnosti in mednarodne zaveze ključni dejavniki, ki vplivajo na pogostost izvrševanja smrtne kazni ter na dolgoročne abolicionistične trende.

Title:A comparative analysis of the death penalty across countries worldwide
Abstract:A comparative analysis of the death penalty was conducted across five countries with diverse legal traditions and political systems. The thesis examined the historical development of capital punishment, its main theoretical foundations, and the international legal framework governing its restriction and gradual abolition. The analysis focused on criminal law provisions, procedural safeguards, categories of capital offences, methods of execution and statistical data on sentencing and implementation in the United States, Russia, Iran, Saudi Arabia and India. Findings indicate that the retention or abolition of the death penalty is influenced not only by legislation but also by broader political, institutional and cultural factors. Whether the punishment is retained in a given country is linked to its rule of law, religious norms, civil society dynamics and public opinion. The comparative overview identified three predominant models: high-frequency retentionism (Iran and Saudi Arabia), low-frequency retentionism (the United States and India) and de facto abolition despite formal retention (Russia). The analysis further demonstrates that procedural guarantees, democratic standards and international commitments critically shape the prevalence of executions and contribute to long-term abolitionist trends.
