Title:Istočasnost napada in obrambe kot kriterij silobranskega instituta – interdisciplinarni pogledi in analiza sodne prakse : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Ne glede na pravni sistem se za presojo legitimne obrambe poleg še nekaterih drugih predpostavk zahteva, da je obramba nastopila istočasno s protipravnim napadom. Z drugimi besedami, zato da se oseba v kazenskem postopku lahko brani s sklicevanjem na silobran, je treba ugotoviti, da je ta posegala v pravice napadalca takrat, ko je bil napad oziroma ogrožanje branilčevih dobrin že začeto, še v teku in še ni prenehalo. Trenutni pravni instituti silobrana sicer izvirajo iz naravnega prava, a zaradi neupoštevanja določenih antropoloških oziroma naravoslovnih dejstev ne zrcalijo realnosti človekove reakcije na ogrožajočo situacijo in ne prepoznavajo dejanske dinamike spopadov, v katerih naj bi branilec imel pravico do ukrepanja in zaščite svojih najpomembnejših dobrin. Interdisciplinarno nepodkrepljeni instituti v sodnih dvoranah vodijo do nejasnosti, previsokih pričakovanj glede branilčevih odzivov in neenotnega sodnega odločanja. Normiranje nečesa tako ranljivega, kot je obramba telesa in življenja pred nedovoljenimi posegi, pa za namene zagotavljanja pravne varnosti terja uporabo vseh spoznanj o človeku in njegovem delovanju. Le z izčrpnim interdisciplinarnim sodelovanjem lahko od pravne stroke pričakujemo dejansko zavzemanje za pravičnost.

Title:The imminence rule in self-defense – interdisciplinary perspectives and analysis of case law
Abstract:Regardless of the legal system, the assessment of legitimate defense in cases of self defense requires — in addition to certain other prerequisites — that the defense occurred simultaneously or against an imminent unlawful attack. In other words, for a person to be able to defend themselves in criminal proceedings by invoking self-defense, it must be established that they intervened to protect their rights at a time when the attack or threat to the defender's interests had already begun, was still ongoing, and had not yet ceased. Although current legal concepts of self-defense are rooted in natural law, due to a failure to take into account certain anthropological and scientific facts, they do not reflect the reality of human reactions to threatening situations and do not recognize the actual dynamics of confrontations in which a defender is supposed to have the right to act and protect their most important interests. In courtrooms, interdisciplinarily unsupported laws lead to ambiguity, unrealistically high expectations regarding the defender's responses and inconsistent judicial decisions. However, regulating something as sensitive as the defense of one's body and life against unlawful interference — for the purpose of ensuring legal certainty — requires the application of all knowledge about human beings and their behavior. Only through comprehensive interdisciplinary collaboration can we expect the legal profession to genuinely seek justice.
